Most student loans are presumed to be nondischargeable in bankruptcy. However, you can file and adversary proceeding within your bankruptcy to determine if it can be discharged. You must how EXTREME economic hardship and this is nearly impossible to prove. If you can breathe and hold any type of job, chances are you won't be able to get a discharge of the student loan.
And contrary to what somebody else posted, Chapter 11 has NOT be eliminated. |

Bankruptcy does not get rid of debts anymore. It requires you to go through credit counseling. If nothing can be worked out of it you might can wipe the debts off partially. The law has changed in favor of creditors now and no longer protects consumers.
However student loans are very different than regular credit obligations. They are treated more like taxes than credit so I think that they are protected from bankruptcy even under the old law. Reason is they are government backed loans. If you dont pay it, they will take any money you make off of lotteries, house, boat or car sales that you make money off of. Anything of title.
However it is very, very easy to refinance student loans, consolidate them into real easy payments. |

You can not get rid of any loans that you have out anymore. Legislation was signed just before the New Year getting rid of Chapter 11 bankruptcy. Chapter 11 allowed you to declare bankruptcy and it would sort of get rid of all your debt. Apparently according to the other answers it did not include student loans. Chapter 11 though is no more. And for good reason. You should have to pay back your debt. Get a job or a better paying job be a man and pay your **** back. |
