I'm a banker (booo, I know) so I have seen this happen many times. If you have a loan and are falling behind on the payments to where it could get into a collection standpoint, then absolutely they can pull any funds you have at the institution. That includes any money you may have on a joint account even if that truly isn't your account. You have access to that account so you are legally bound to it. My question to you is, if you had the funds in your account, why did you fall behind on the loan? You know you get charged fees and extra interest for that. Not to mention you are wrecking your credit. The best advice is to find a way to stay on top of your loan and pay it on time so this type of thing doesn't happen again

yes they can.... when u except the loan you sign a contract agreeing to pay it back... if they have access to ur account, yes they can. just like if u owe the IRS they can legally take things from ur home

I dont think they can take it unless you are late with your payment though

Yes, if you signed a document allowing
the bank to do so. I saw a bank document
that permits withdrawal of money from a
savings account at a specified date ( 5th day
of the month ) to pay for a housing loan
amortization.

It depends on the terms of the loan. Read the paperwork that you signed.

They can when you sign up for automatic withdraw or something like that. My bank did everymonth. You might want to go over your loan papers and read EVERYTHING. Because most of the time the bank doesn't screw up. Read the fine print. Go talk to someone I am sure they would explain it to you. Good luck.

Yeah, mine does. Although, you should look through the papers that you signed when you created the loan. As most banks go, they can usually take the money out of your account, though they usually will tell you.

YES! When you took out the loan, you almost certainly signed something saying that all assets you have on deposit with that bank can be used as collateral on the loan. This is very common, and perfectly legal. Read before you sign.
