Joshua L | Can a collection agency take action if I have no income, no job, and absolutely no money or assets>? |
If they cannot take action, what laws or cases can I cite to defend myself if they try to manipulate me? What can I do? |

If you truly have NOTHING in the way of income, money or assets, it begs the question -- how on EARTH did you get so far into debt that a collection agency is now coming after you? :( Seriously! Something about this sure doesn't add up. Did you really think you could keep buying without eventually paying?
Unfortunately, only President Shrub can spend money like water and not be held responsible for the trillions of dollars of debt he's racking up. The rest of us do have to pay up when we purchase stuff, and we can and WILL get into big trouble if we don't!!
Sorry you had to learn this the hard way, but hopefully once you get out of this jam, you will be wiser and won't let it happen again. :) It's never too late to start over and improve! Good luck, and I mean that sincerely. |

They can force you to sell your blood and semen. |

They can report the debt on your credit report. So whenever someone checks your credit- including credit card companies, and apartments- they see the debt. |

they can take action it just takes them longer to receive there money until u get ur self together |

sure they can . You are basically uncollectable but if you ever open a checking account in the world they can grab the funds with a default judgment which they will get . Same with a bak account , inheritance , stocks , cars , houses , land , real estate and they can wait till you are 65 and grab your social security as there is NO time limits on the collection unless you file bankruptcy and under the new laws that is tough to do so you might just want to pay up or work a plan for repayment unless you want no life ! Your choice !!! |

if you have no assets, how are you able to leave a question or access the internet with a computer? That is an asset. Which if you have an internet connection... you live either in a house or somekind of domicile... then you must have some clothes... however that is beyond information.
So I fail to believe you are destitute. |

Legally they can. However, the fact is you cannot get blood from a turnip. Based on what you have said, it is unlikely that they would pursue legal action in your case, especially if you owe less than $5,000.
If you need qualified legal advice, try www.legalaid.org as I am not an attorney. |

They can get a judgement against you and try to get it enforced. Once that happens, you can only stop them by settling with them or declaring bankruptcy. You can also ignore them, as you cannot go to jail for owing someone money. |

if you do not own any assets all they can do is threten and harass you talk to a lawyer or file bankruptcy but really no need they cant do anything if you dont own anything or have any money you wont go to jail |

you must live some where and have a phone because they are getting a hold of you..talk to a lawyer,a credit counsil,or file bankruptcy, this will stop them from contacting you .. get things straighten out soon ...it won't get any better till u do..further down the line if you do have income or a house they can get $ when u decide to sell it.. |

If you have nothing to take, they can't take anything. But be assured as soon as you start working, they'll be in touch. |

Communicate with debt collectors only in writing. Refuse to communicate with them in person or by telephone. Debt collectors prefer oral forms of communication because it works to their advantage. Written communication works to your advantage because you have a record of everything that they say. Debt collectors are less likely to use unfair and deceptive tactics if they have to put what they say in writing.
Fair Debt Collection Practices Act:
How To Deal With Debt Collectors
Make a plan in Writing to pay them monthly payments of XXX when you start working. It's better to start low and then you can work up. Be aware that they can lower the total by half if they want to. Stay on their good side, but stand firm. Check out the following web site:

Depends on which state you live in now and in the future. They can only garnish future wages for taxes and child-support in states like NC and SC. In other states they can take money from your paychecks for anything they want as a collector. Since you own nothing now, this is obviously unsecured debt. Unsecured debt will always pretty-much be up to you whether you pay or not. Your credit stays harmed, but it's not like taking your car or house. If you can wait them out for 7 years, most of this will vanish from your reports. NOTE: if you start making payments to them on this and stop later on--the 7 year ticker starts from last activity on your part. So, if you think you might not pay it all-don't even try or delay the 7 years timing out for you... |

All you have to do is tell them not to contact you any more. Under the Fair Debt Collection Act, that stops the contact.
However, the debt remains. It is far better for you to gather 20 percent of the amount owed and offer to settle that as "payment in full." |

God you people are stupid. You can get on a friends internet to ask these questions. Some debt comes from hospital bills so its not like you were out on a shopping spree. Not everyone has the ability to get a good job. So if you are say 20 with hardly any job experience in a bad economy where there are no jobs. A grocery store near me puts up a help wanted sign for a bagger. 20 people apply for 1 job. Even if you get the job somehow its not like u are rolling in money. Pay basic expenses where is left over money to pay hospital bills that u have because u cant afford insurance because not everyone gets health care in this country. |

My son lost his job along with 200 people at the same company almost two years ago. He lives in a very hard hit area so has not been able to get even a part time job. Now his wife who is employed, and during this time bought a house, took out five credit cards, and continues to rack up debt decided she wanted a divorce. So now he owns his clothes. He sold his car, he stays with me, he has no income, no assets, no job. I am on unemployment. what can we do with his credit card balance? |
