She cannot report you to the collection agency on her own. You know you owe her the money, pay her. Noone buys you a cell as a gift and pay the bill afterwards.
She is choose to, she can file a small claim suit. If she wins the suit, the credit agencies will list you in their files. |

Why aren't you paying your own cell phone bills by now? Here you are worried about your own skin, while still using the thing and not paying for it after a year? Give the phone back or start paying for it. As far as paying for the last year, that was her mistake for paying for it for that long. |

No...she has not authority to report you to the credit agency. The only one that can do that is a buisness that you have given you social security number and information to such as your DOB, Credit Card Number, etc...don't sweat it love |

Ok, think first about the situation. The first thing she has to do is to show that there was a contract in place. It doesn't seem that this was the case; this would have to be judicially decided and enforced.
This hinges on whether the cell phone was a gratuitous promise ~ gift, or a bargain. From what you've written, it seems very convincing that this was a gift, with no expectation of consideration, or payment, from your side. It was for graduation, and there is no objective reason to think that there was any "deal" in place. Further, you cannot get consideration (i.e.,, payment) for past performance / actions when not agreed to at the time. There is no implied contract here.
I would just make the payments from this point forward, because now you're on notice, and you know any payments on your behalf are not meant to be a gift. So, in sum, before your fight, you probably will owe nothing. Any reporting to the agency would have to be done after a decision is judicially mandated, because then any claims anyone would make, regardless of validity, would be reported. She can judicially require you to pay what is owed after demand. If you did not pay after it's judicially required (maybe even if you do pay after judicially required, but even for the $ you didn't pay that she took you to court for), this can be reported to an agency.

Well, a person cannot report you to a credit agency, not as far as I know at least. However, if there was an oral agreement that you'd pay for the phone, they could take you to court if they wanted to to recover the payments. |

NO...She would first have to take you to court, and win a judgment against you. If you don't pay the judgment (as prescribed)at that point she could hire a collection agency, if you don't pay them, they would probably report you to the credit reporting agencies |

Only a company can report you to a creit bureau, so if your family member is part of a company either as part owner or used the company's money to loan to you then yes, they can report you but you must have had something in writing with them. A deed of loan drawnn up by a lawyer or notary. |

whatever the issue if she does you can go to the credit agency's website and challenge it. She will have 30 days to prove the debt exists or get it off. |

You hold all the cards. If she gave you the cell phone, it's in her name. She can try and take you to small claims court, but you would probably win there too. She would have to prove that she reasonably expected you to pay, which after a year of not paying, that expectation is lost. Give her back the phone and be done with it. There is nothing in your name she can report. |
