Can the ex-wife collect on her ex-husbands social security benefits when she retires?
I live in Ohio. I was married 20 years.
Additional Details
I thought if you were married at least 10 years you were vested and had the right to claim on his SS.

The explaination, as I can understand it, from SSA, and their FAQ's is that a wife married 10 yrs or more, and then divorced, if not remarried can collect.

My advice, apply for it, and see what happens then.

From my experience, get an advocate, like a legal services, senior help group, AARP, or other group which you might have an affiliation with. Govt agencies tend to mess around less with people who come with a posse.

Good Luck

In some places, yes. I had to sign a waiver that I wouldn't even though we were common law.

yes; But check with your local social sercurity office and your job

annie
no, the only ones who can are the kids from the marriage. that are under 18 i believe.

10 years BABY is the golden ticket......Vested has nothing to do with it. As long as you are eligible to receive SS and have NOT remarried, you get your portion!!!!

Yes, it is very probable that you can draw against his earnings. Usually this will be negotiated during the divorce, but is not mandatory. Good Luck!!

I don't see how you could, or why you should be able to do so.

No. your divorce cancelled all access to his SSI or any property from his estate.

Reagan
Not if you are divorced. If you no longer have any claim to his assets, you also no longer have claim to his Social Security.
