I wonder if the funds weren't available in your employer's account and your paycheck didn't clear. It's not that the employer took the money back, but your check was no good. Your bank posted the funds to your account on the assumption the check would clear. When it didn't, the bank reversed the amount since they never received the money.
I'm really sorry for you. Hopefully they're giving out a contact for questions about past pay. Otherwise, maybe there's a lawsuit being formed for employees to get part of any bankruptcy settlement. You probably won't get everything you're owed, but you may get something. You're going to have to do some legwork though

Wow that sucks..take all the paper work you have layoff notice and bank statements and go to your local Labor Board and ask what to do..they should be able to help you..I hope you don't have to go through a court battle..Best of Luck to you. |

Legally, what you have rightfully worked for is yours, whether it has been paid or not. And they definitely should not have taken back the money.
I can only think of one other explanation - that is the check they gave you didn't clear and bounced... thereby having the bank reverse the deposit. But I'm pretty sure they can not go back in your account to withdraw funds - only the government can potentially do that.

I am in the same boat my husband I am guessing works with you if you e-mail me I will give you the name..we are going through HELL let me tell you we now have NO money they have taken all of it and now our check book is bouncing GRRRR..we don't know what else to do we even took a ride by WORK and nobody is there(SURPRISE)..we don't know if we should get a lawyer or not but I am sure anyway by the sounds of things that you also work with my husband! maybe we should all get together and do something about it!!! |

I don't think they can do that... you have to be compensated for the work you did there.
You should probably consult a lawyer and see if there's anything they can do to help you get back your hard-earned money. |

They can't take it back. I would first speak to the bank. They cant me a withdrawal from your account without permission. But You and your fellow employees should look at legal action. |

I don't know exactly what kind of bankruptcy your company is going through, but generally speaking a company has more of an obligation to its creditors than its employees. Seems unfair, but when you think about it the creditors ostensibly own part of that company until they are paid so when a company closes it must pay all of its owners first.
So generally speaking their gonna pay
1. Creditors
2. Bondholders
3. Preferred Stockholders
4. Common Stockholders
5. Then whoever else is still owed money aka. employees |

You need to contact your state or federal Labor department. Your former employers behavior is fraudulent and should be reported immediately. I would also contact your bank, and ask them how they can legally take back a deposit. Contact your state and federal banking regulators if their response is not satisfactory. |
