Can you claim back bank charges?

Yes you can, and I can help you do it (for free!!!)

If you are in the UK, you can claim back your bank charges for the last 6 years (5 years if you are in scotland)

The process to claim your charges back is:

1) Write to the bank and ask them for a copy of your charges for the last 6 years, or alternatively a set of statements for the same period. You do this by making a "Subject Access Request" under the Data Protection Act, enclosing a cheque for ВЈ10 made out to the bank. This by passes the banks normal charges for statements which is normal a large amount for 6 years worth. The bank have 40 days to send you the data.

2) Write to the bank asking them to refund your charges, giving them 14 days to reply, attaching a "Schedule of Charges" (a list of the charges you are claiming for).

3) Send the bank a "Letter before Action" giving the bank one last chance to refund your charges before you take court action. They have 14 days to reply.

4) File a claim online using the Money Claim Online web site run by the UK Court Service. The claim is served on the bank 5 days after its submitted. The bank has 14 days to acknowledge the claim. If they don't you can request a "Judgement by Default" and you win the case, and get your charges, statutory interest at 8%, and your court fees.

If they do acknowledge the claim, they then have 14 days to submit a defence (making 28 days in total from the date the claim was served). If they don't then you can again request a "Judgement by Default", and get back your charges, interest and court fees as above.

If they file a defence, then you and the bank get an "Allocation Questionnaire" to fill in. Some judges dismiss the case at this stage, as the bank can't win, so again you win. If this doesn't happen, a hearing date is allocated. The bank will either back out before the hearing, or won't turn up in court. Again you win the case and get your charges, interest and fees.

Follow the correct procedures and you will get your charges back! Its important to send all letters to the bank and courts by recorded delivery, so you can prove they were received, and more importantly when they were received (which you can find from the tracking section of the Royal Mail web site).

Also make sure that you send all letters to the banks head office, and not your local branch. Don't phone the bank either, as this can delay things and you have no proof of whats been said.

yes you can claim back upto six years of bank charges if they are found to be unfair there are plenty of websites that help you do this just google search under bank charges

Yes, have done it successfully on an overcharge. Didn't stop them from overcharging again, mind you! Problem is getting the Bank to respond to your queries and refund the money in a timely manner. Didn't get back the interest they earned on my money whilst they had it in the bank either. Nor compensation for all the time it took on the phone trying to sort it out. Seems it's one rule for them and another for their customers (sorry clients). What happened to banks caring for their customers or is it just a big money-making business for them after all? Mmmmmm...must speak to my Bank Manager again about that one!

You can try, as my husband has.But so many people are trying to claim their charges back now, the banks are fighting back by sending replies that are very cleverly worded.They have been lots of questions about this on here, have a look through the 'search for questions' box at the top of the answer pages.

Yes you can, they will keep writing to you with every excuse in the book but keep writing back and pestering them.My Daughter did and got ВЈ500 back.

also i think that to claim back the money you have to write a letetr to your bank showing the charges. or just go to the bank.

Martin Lewis, the guy who writes this (appears on TV all the time)started this revolution. It has a very detailed article on how to reclaim bank charges. It includes template letters to send for the various stages of the claim (over 1,000,000 have been downloaded so far!!!). It also tells you the different addresses to send your 1st letter to ....NOT your usual bank addresses.... but the address to get copies of the charges.

It is a brilliant site. I would recommend everyone to subscribe. It's free and they do NOT SELL on your address or bombard you with spam.
