maybe a little less money to give back seeing you have paid taxes on the gross..
and also to see if you can pay it back slowly with OUT interest.

Chill they wont take $1800 at once they will slowly deduct it from his check. Probably about $30 per month. |

Unfortunately, they can demand the money back in full, however, you may be able to work out a payment plan with them. I suggest talking to Human Resources, they may be able to help. |

Even though it is an accounting error, your husband still received the extra compensation without question hoping they wouldn't catch it.
Unfortunately they are entitled to have the overpayment returned to them.
You have to think of it this way ... What if the company's error instead shortchanged your husband's hours and he was underpaid? He would immediately demand compensation for the hours worked that he was not paid for.
The same applies here. Legally they are entitled to their money back. (Even though I'm sure you were hoping for another answer).

They can't demand it back all at once. It may not be reasonable for you to know you were being overpaid. Let's say your paycheck varies each payday due to deductions, taxes, and such. If each paycheck varies around $1457.32, the error might be something you may not see.
The money will have to be paid back, no doubt. But, they can't demand it all at once. Work out a deal where it can be paid back $60 per month.

no way... if they make you pay it take it to court and appeal it. they shouldnt make accounting pay for it. or they have insurance they can jsut get it back form them... you should not have to be penalized for there error.

Yeah, I am pretty sure you have to pay it back. But I would look in to it more. i would call a lawyer and ask what are your options. Seems to me they are the ones at fault not you. Even if you have to pay it back-Maybe they will let you do it in payments. That's why it is best to call up a lawyer and ask what you can do about this! |

Sounds pretty shifty to me... I'm pretty sure they'd try to sue you guys if you don't repay, but even if that were to happen, sounds like a really ******* weak case on their part lol. |

Have them take out 30.00 a month for 15 months. I know thats a 60.00 swing, but if they want the money back I don't see why they would want it in one lumb sum. |

He need to talk with his supervisor very often companies are willing to work out a plan. Most companies are very understading of honest mistakes. The company may be willing to take the $30 each week to correct the mistake. Ask you might get help |

This type of **** happened when I was in the Army to people all the time. They all had to pay the money back.
They would work out a payment system for those would couldn't pay all at once - maybe they will withhold 30 bucks a week for the next year and a half. |

i work for a union company and i can tell you we had guys that have had to pay us back if they were overpaid. although it was an accounting error, your husband should also look at his paychecks to make sure everything was correct. if he had any questions about anything he should have asked the payroll dept.
it's totally going to depend on what the union tells you but i would be prepared that you will most likely have to pay it back. sorry. |
