RichsGirl | Debt Collectors won't stop calling!!!? |
About a month ago a number showed up on our caller ID for Allied Interstate. We researched the name and found out they are a debt collection agency. Okay..this is the problem..we have no bills/debts/anything that are late or in any danger of being placed in collections. We had a bankruptcy almost 7 yrs. ago because of medical problems but we've been paying everything on time since then.
Everything I've read says this is a really unscrupulous company, so we are not talking to them on the phone. But I did send them a certified letter telling them to cease and desist with the calling and send us in writing info on whatever they were trying to collect. They still keep calling, I sent them a fax, they still call, and we have still not received any proof of any debt or anything.I'm beginning to think this isn't a legitimate debt. That maybe they bought one of our old bankruptcy debts. What can we do short of having to hire a lawyer? SERIOUS ANSWERS ONLY!!!! Additional Details You all have some very good points , but... We have never had a student loan, and we have no debt problems right now. Do a search on Allied Interstate Inc. and you will find ALOT of info on them. They ignore cease and desist letters, they will not believe you if you tell them they have the wrong no. or person, or you don't owe any money, and they will not send you anything by mail. I did send my letter by certified mail and kept a copy and of my fax too. If they have my phone no. they also have my address. I am not dealing with these people on the phone, they are bottom feeders, who abuse and threaten people on the phone. If you ask them who/what you owe to they tell you they CAN"T tell you just need to send money!!!! According to the law in my state they should have sent me all info. within 5 days of the first call and its been almost a month. I am going to file a complaint with the Attorney Generals off. and the BBB. |

Don't waste money on lawyer. Answer the phone and see who they're looking for. If you have no debt then there is no reason for them to call. Tell them to put in writing if they think you owed them the money.
I have HSBC called me constantly looking for someone else that I've never heard of. I called the company and file a complaint in writing. I wrote to the president of the company and told them that his company should stop calling me. I never heard from them since then. The company never apologised nor they never responded to me. One thing I know that I got their attention and they stopped calling.
Go on line and find out their president's name. Write to him/her directly. They don't like publicity. |

contact your telephone company and subscribe to "Selective Call Rejection".
you then can hit *60 and enter up to 30 different telephone numbers to block.

Your best bet would be to answer the phone and find out why they are calling. If it is something rediculous then you can always just hang up, mid-conversation. Are you on the do-not-call list? I think you can register on www.donotcall.gov (or something like that) |

in my job i've dealt with allied interstate before... but only when they were trying to collect on employee wages for federal student loan garnishments.
as far as i'm aware, those do not get included in bankruptcy so, if you had a student loan (or co-signed for one) then this could be what it is for.
either way, accept their call and ask what it is for. just talking to them is not going to hurt you. |

I would answer the calls and tell them to stop calling you and tell them you wrote them a letter requesting this. If the calls don't stop, keep a log with times and dates they call. Bill collectors are only allowed to call so many times a week and between certain hours.
If they continue you can actually file a lawsuit against them for harassment and be sure to keep your certified letter as proof that you did request this.
You might also check your credit report and see if there is anything from allied credit on it. |

First, just verify they received the letter. If they continue to call, write another letter informing them that they are now in violation of the Fair Debt Collection Practices Act-federal law that governs all US debt collection practices. They are required by law to put in writing the disputed debt and to stop calling you because you requested it. Let them know any further attempts to call you will result in you filing a complaint with the Federal Trade Commission. And that is easy to do-go to the FTC's website and there is a complaint form.

Until you answer the phone and find out what they want you will never know. You can inform them that you sent a letter on XYZ date asking them not to contact you by phone any more. Unless you sent the letter certified I guarantee you they are going to say they never recieved such a letter...and unless you know what debt they are trying to collect and have your account number on the letter they probably had no idea what to do with such a letter...places like this work only with account numbers and not names.
Answering the phone will not show your willingness to pay the debt, it will show your willingness to get them to leave you alone.
PS: Did you know that debt collectors can contact any of your known associates to try to get your information? Maybe this is not your debt they are trying to collect, maybe they are trying to get a family member or friends phone number for a debt they owe. You will never know what they want until you answer the phone. |

If they continue to call you even after your letter, it's better to speak to them when they are giving you a call next time and find out what do they want. We get hounded constantly by debt collectors too, as the major breadwinner in the house is unemployed.
There are two things that you can do: 1) Get the phone number, call them back and tell them to put you on a "do not call" list. They will hassle the heck out of you, but they legally have to take you off their call list; and 2) Get an answering machine that allows you to phone screen and just completely ignore them.
Truth is, only SOB's like Citibank and MBNA will eventually file a lawsuit against you, then they will settle for about 60% on the dollar to pay them off. Everyone else? They just threaten your credit and it you periodically check the credit reporting agencies and find a descrepancy, you can write to the credit reporting agency and ask them to remove the disputed item from your credit report.
I am an expert at getting screwed; trust me, you don't have to put up with the harrassment you're going through! |
