Debt collectors harassing and rude ?
Hello all , here is my question I received a call from a collection agency Wednesday which kind of shocked me plus she was borderline rude etc no real rude best describes her. She said I have a balance with the VA state tax for tax year 1996 the amount is $1740.00 ok This is the first i became aware of this issue on Wednesday past I had cancer back then was married etc.. So I called the Va tax dept she noted my account and is mailing me info re the debt I am not working now also due to this economy . Then today the collection lady calls me askes if i am going to pay i said i am waiting info and paperwork from the VA DEpt of taxation she said she didnt care and was going ahead to get the money in whatever ways she wishes I do not have property etc and have money in the Bank what can they do ie i heard about it Wednesday she said they are proceeding with collection action Please advise oh the tax return was a joint return for the state not the IRS I also have a credit with the IRS for $3200.00 as i filed an amended return they accepted it so wow but they have not sent me a check just shows i have a credit on my account .. ANy advice gladly welcome Question is in the next few days will can they go to my bank account and take that money how long does it take for them to and if to do this action..
A few of you asked me re whos making the claim calls etc Its a collection agency "Diversified Collections" I am not get calls from the VA Dept Of Taxation State . The lady from that agency called me this am and she was wow so rude and said they will be proceeding with their action .I expalined I am awaiting paperwork back from the VA State Tax regarding what specifically the debt is for in more details they have noted that i am not working .I do have money but just not working between contracts .Dont i have to receive notification before they can withdraw funds from my account ???

Hi Mary,

the following is based on my experience in NYS, so please keep that in mind....however, most states follow a similar, if not equal format for collecting back-owed taxes:

a *collection agency* may NOT *automatically* freeze any accounts, take money out of them, etc, *regardless* of who they are working for....

*however*, a collection agency *may* do so ONLY if they have been LEGALLY authorized to - and that means, the following conditions would have to be met:

IF a *JUDGEMENT* has been filed against you in court in favor of the other party (in this case, the other party being the Virginia Dept. of Taxation), AND the collection agency has been hired on behalf of the other party to collect this debt.

in other words, the State must first legally file a claim against you in court - in which you'd be notified ahead of time, of when and where it would be - you would be issued a summons to appear in court first, in which would usually be SERVED to you - in other words, a person would come knocking on your door with the papers...

then, you'd be given the chance to show up in court and explain your side of the story to the judge, including providing proof that you have money coming from the IRS that can help cover the debt, and that you are between contracts right now - providing the judge with a copy of about 2-4 years of bank statements, and all assets and any other outstanding debts...i'd check with the courts ahead of time as to what they require....

you may possibly be able to convince the judge not to issue a judgement at that time...instead, the judge may opt to set up a payment schedule - in other words, the judge can require that you pay a certain amount of the debt per month, ON TIME, until it is paid in full - and possibly, include a requirement that if you receive any refund from the IRS, that money will go *directly* to pay off this debt....

however, keep in mind, the IRS and your state's tax department are *two separate entities*...therefore, the judge might choose NOT to base his decision on the fact that you'll be receiving a refund from the IRS soon....

also, you stated that the IRS refund was from an amendment to a JOINTLY filed tax return...therefore, that refund legally belongs to BOTH you and the other person listed on your return....

if the IRS says the payment has already been made, yet you haven't received it, the other person listed on your tax return could have possibly received and cashed it without your knowledge (illegally, if they didn't obtain your signature) - *OR* they could have LEGALLY had it deposited *directly* into THEIR checking account - it depends on how you *initially* filed the tax return in which you signed.

in any event, i'd simply stop answering the phone when the collection agency calls until you get this whole thing straightened out...even if that involves having to shut off your ringer on your phone and letting your answering machine get your calls....it's a pain in the butt, but you'll save yourself a whole lot of stress by doing so.

...first... "they" must follow the rules set in the Fair Debt Collections Practices Act... "If" they violate the act you can win a BIG award in your favor... Ck on line for the F.D.C.P.A. and if you feel "they" violated it...call your State Attorney General and make a formal complaint... also, when "they" call you... tell them NOT to call anymore and only contact you by mail... they have to comply... About your Bank account... If "they" get a judgment against you... 'yes", they can seize your asserts, i.e. bank accounts real-estate etc. so, protect your money... open an account in your child's name or relative who has no issue with "them".

First off, what they are doing is ILLEGAL. All you have to do is tell them "Do not call this number again". If they do, record the dates and times and, of you can, the name of the person calling. Then go online and report it to the attorney general in your state.
Besides that, a collection agency cannot DO A DAMN THING!! They are powerless to seize your property or bank accounts. Only the Federal Government can do that. They can get a judgement that really isn't worth the paper it's written on.
Also, when you do pay the tax bill, pay it directly to the state. Collection agencies generally do not report some of the debts they recover, meaning it will never be rectified on your credit.
The main thing is "Do Not let them intimidate you!!". If you have caller i.d., just ignore calls from that number or any "annonymous" or "unavailable" caller.

it take s time and a court order to attach your bank account.
they want you to pay them if in fact any money is due, not the IRS. if you pay the IRS they dont get paid.
they arre not going to be able to get a court order for anything in less than 60 days so you are safe there.
as you the taxs owed call the local tax office to inquire as to how this has been on the books for 12 yrs and no one has said anything.

to me it sounds like a phone scam so you give them Credit card info and get robbed blind.
try to get the callers name and number and all the other infomation for you records.
if it is in fact a agency they will give you all that infomation . if not BEWARE

Quit messing around on this forum. Call the VA tax collection office in Richmond. They are very easy to work with. I have dealt with them and I was surpriseda t how "user friendly" they are.

You shouldnt owe money in the first place. How would you deal with people who owe you money and they wont give it to you? Im sure you would harrass them too. Come on dont be ignorant.

I don't know the answer to your question about whether they can take your money....I know I would have money on the side for an emergency...I also want to answer the rude part...I have had people call me who were so rude...I had hospital bills & a son who died. I am usually so nice but this man was so rude to me I said something that shocked people who know me but I have no guilt...I told the man I didn't have it & I explained why & he still didn't care so I asked how I could do that....he was so mean to me I said "I have a child that died, maybe that will happen to you so you can then understand" My family & friends were shocked I said that but he did care about my lose. so I just want say they are just like that don't take it personally...You are not alone if don't watch the news I can tell you more people are going to lose their jobs than have them.

There is actually a law against them harrassing you like that. And there are things you can do to get them to stop. There are places you can report them to like the Credit Bureau, and if you let the debt collector know that you are aware of your rights, she should back off. They also cannot take your money AT ALL. Just don't give them any banking information because you aren't even SURE if this is a real debt collector or a scam artist. It actually sounds like she could be a scam artist to me.

What you want to do is tell the person you are sending a Certified Cease and Desist Notification and that you looked up the phone number from your caller ID and found the address on the internet. I did this to this guy one time that kept harrassing me. I never sent the letter, but apparently this scares the crap out of them because he's never called me again. I also told him I had filed a complaint with the credit bureau and that may have helped my situation out. I did look up his address on the internet from my caller ID and when I told him to what address I was sending the letter -it was his! Someone on Yahoo Answers told me to do it, and I tried to find the old question I asked, but it has already been "recycled" I believe.

First of all any collection agancy have no heart. There job is to be rude and collect back as much money back from you as possible. I have a few friends who work for collection agency and they have told me that they have to be tough.

Secondly, as for withdrawing funds from your account. I believe that they have to go through courts and get a garnishment prior to doing so.

I am sorry to hear that you had cancer, and many people do fall behind on bills due to that fact. I hope everything works out for you. Keep your head up and stay strong. Everything will work out.

PS. Maybe try giving them a timeline, call the IRS and explain the situation and see what they can do to fasten the process of getting your refund and how long. Ask the credit agency if you can fax them a copy of your tax return indicating that you have a refund with the timeline and hopefully this will give you more time and less harrasment.
