You may be able to cash the check with one signature, but not legally.
The check belongs to both of you. You want to take the money for yourself.
It sounds to me that you have bigger problems with your marriage than a tax check! |

I worked in a bank for 10 years. We required both signatures and they had to sign the check in front of us. It was for legal reasons. We had a situation where the wife cashed the check without the husbands signature, the couple ended up getting divorced and the husband questionsed the IRS about where his tax refund was. The IRS went back on the wife for the money and the bank fired the teller for not following proper procedure. It can be considered fraud when you cash a governemnt check without proper endorsement, especially when your dealing with the IRS.
Don't decieve your husband, have him sign the check. |

Nope, it only needs one signature. Deposit it in your joint checking or savings account, that should do the trick. That shouldn't be a problem. My parents got the double-name check too, but only my father signed it and there were no problems.
Both of you should go cash it, just to play it safe. THEN GO SHOP SHOP SHOP SHOP! Have a blast girlfriend! |
