It was defaulted and heard nothing more about it But had baby with my fiance and we are planning to buy a house checked my credit file and it will have been 6 years on the 17th Nove 08 sincedefaultedd but I haverecentlyyreceivedd a letter from the debt company to pay it, do I still need to pay it as I can't afford it at the mo, Am getting very worried about it, Do i pay it or ignore it??!! |

This applies to England and Wales. Different rules apply in Scotland and Northern Ireland.
If it was defaulted six or more years ago it may well be 'statute barred', meaning that it can no longer be enforced through the county court system. It will be statute barred if six years went by and a) you didn't make any payments b) you didn't acknowledge in writing that you owe the debt and c) the creditor has not got a County Court Judgment against you. It makes no difference whether the creditor has tried to contact you or not. If you made any payments or acknowledged the debt within the 6 year period the clock would restart at that point. But if it ever goes *past* six years it will always be statute barred. If you are close to the six years you should be careful about writing to the creditor or collection agency or you may inadvertently acknowledge the debt and restart the clock.
If you notify a creditor that a debt is statute barred it THEIR responsibility to show that it isn't. They would need to do this to get access to a County Court Judgment.
See the website www.nationaldebtline.co.uk for a fact sheet that sets out the rules in more detail and has a sample letter you can use to write to a creditor informing them that the debt is statute barred. If it turns out that the debt isn't statute barred for any reason, you can get advice on dealing with it from the same site. |

If it has been at least 6 years and a day since you defaulted, no. You don't have to pay it off. Ignore it. If they send a second letter, I'd suggest you go to your local Citizens Advice Bureau and ask them for advice. |

The debt will stay with you for ever. Do not ignore the letter you have received as you could have a visit from Bailiffs to secure belongings to the value of the debt. Write to them and explain your difficulties and make them a reasonable offer to pay back at monthly instalments. They might negotiate on your offer but they wil be happy that you have made the first move. Clear the debt as it will have an impact on your ability to get credit for a long time. Be straight, be honest and come clean. You will be all the happier for it. |

Never ignore letters from debt (loan) companies - worst thing you can do.
Defaulting on the loan means that you don't have to pay back interest - I believe that your debt is wiped from your credit rating after 7 years...contact National debt line..they give great advise on this kind of thing.
You will have to pay back this debt sooner or later.

Take a look at the letter you recently received from the company trying to collect the debt. Odds are it's not from the same company that you took out the original loan from. The original company has since written off the loan from their own books and sold it to another company for a small percentage of the original amount.
Depending on how the credit reporting agencies work where you are, the bad info from the original default will eventually be purged from your record (It's 7 years after the last activity in the US). You entered into an agreement with the first company. If they've passed it off to someone else then you have no moral obligation to the second (or third, etc.) company, from my own point of view. |

Debt is wiped off your credit after 7 years. So being it hasn't been 7 years yet your still obligated to pay, unless you give it another year. Are both you and your boyfriend on the loan as the signer and co-signer? Are you the signer and the ex- is the co-signer? Not that it really makes a difference because both of you are on the loan both of you are obligated to pay, but if you were the co-signer it sounds like they can not find him. I would force them to go after him by giving them his information if your able to provide any of that.
Ignoring it is your option, obviously the debt is not large enough to file suit against you to collect the debt. I would suggest talking with them to see if you can have the monthly payments lowered, if your able to afford to purchase a home and pay a monthly mortgage (which could be anywhere to $800 or more) then that tells me you can afford monthly payment to pay them off. I would suggest you work on paying them off with a certain time period and then work on getting your home. |

Speak to your local Citizen's Advice Bureau, there is a statutory limit on debts, if it was more than 6 years of NO contact from the people you owe, you may be able to write it off.
It might be 9 years though and you'd have to prove there's been no attempt by them to recover the money in that time, and that you hadn't made any payment either. |
