Do i need a will? ?
Me and my missus are not married but have children? I have saved up enough to by a house soon, now if i die before the house is bought what will happen to the money, and after the house is bought what would happen to the house if i don't make a will.

Go to the library and find a book on wills. See if you can find one with a cd so you can fill out the forms and print them. If not book stores have these.
You type in your info, and it prints out your will. Go to the library or your bank and have it notarized - BOOM - will done. /

If the house is in your joint names then your 'Missus' will get only her half.

The half that's in your name and all your money will be shared between your patents (if they are still alive when you go), any brothers/sisters that are still alive and your kids.

Your 'Missus' will NOT see a penny of your money if there's no will.

And if your kids are UNDER 18 then the Government will hold the money in trust for them.

Everybody needs a will or else the state will get involved. If you have kids then you know you can't leave that up to anybody. You will probably die with some assets and with some debts and you want to make sure the right people are involved and awarded that. You probably have life insurance at your job. It's so cheap some employers give basic policies out for free. At least enough to cover funeral expenses.

your parents, siblings, and missus will fight over what you have. They will all want to be the one in control of the finances of the children. it will be a mess that will take years to sort out in court. It happened to my best friend. In the end she won, and her kids didn't see their grandparents again till they were grown. The grandparents choice. Get a will.

Your children are entitled to inherit up to a certain sum tax free, (in Ireland, €521,208) but your "missus" as she is not married to you, and not a close blood relative, would not be entitled to anything. If you left her a share in your will, she would get only a small amount tax free (€20,060), and then be hit for 20% on the remainder, by the Revenue Commissioners. This could be substantial money. If the house was in joint names, she would be entitled just to her half, under Irish law. It might have to be sold to give the other inheritors their share from your half of the house.

Without a will, your children inherit, so do your parents and brothers and sisters. Your children's mum gets nothing. With a will, she will get something but it can be contested by the above-mentioned others who are entitled to a share - just because you are not married. If this is all the respect you have for your lady, that is the way it will be. If you really want to protect her, and not just give the share you'd like her to have to the taxman instead, you might consider marrying her. This would give her benefits and security far in excess of what you imagine. And spouses are exempt from inheritance tax.

So, now for the real question. Am I invited to the wedding?

It takes a lot longer for the money to come through without a will. As they are available cheaply from places like WH Smith, I would definitely make one.

I'm assuming if the money is in your name only, then your next of kin would get it? Whether that would be your kids or your parents i don't know? If it's in joint names then no problem. Again, if the house is bought in both your names, no problem.

What i would say to you though, regarding you not being married and having kids, i was in the same situation - one child, one on the way and my partner and i weren't married. We were told that if anything happened to me (as in, if i died!) my other half would not have automatic rights or guardianship over our children as we weren't married (We have since married) He is their biological father, named on birth certificate, yet he'd have no rights over them should i disappear off the planet!! So basically, they would go into care until it was sorted. That was our main reason for getting our wills sorted out - just peace of mind that if anything DID happen to me, they would stay with their father! Maybe that would be worth considering, and whilst doing that, sort out the financial side of things too so it's clear how you'd like things to pan out should anything happen?
