You should have thought about that before you walked out. I'm sure your entitled to the wages that your owed but you need to sort it out and be polite about it. |

You're in a very sticky position for 1) not having a contract 2) walking out and 3) not working there very long. The employer could argue that you agreed to a non paid trial. I would walk away and be lucky that you're out of it. Just make sure any future employers give you a contract. You have no comeback in my opinion. Sorry. |

Have you tried writing to the "restaurant", stating all the facts and dates, and request payment of "wages" due.
Keep copies and post "signed for".

Yes you are legally entitled to every penny that you have worked for and they cannot keep it from you. You need to write a letter requesting your pay and state the reasons why you felt the need to walk out.
keep a copy of the letter as evidence and ask them to respond to it within a reasonable time say a fortnight with an explanation of when you can expect your wages. If you don't receive an answer within that fortnight ring acas and ask for their advice but ou must be accurate with the information you give them. |

i would call the manager and ask for the monies due for the work you done if he says you are not getting it then if its his own business's then there is not much you can do other than going to the police and getting advice from them,
but if hes with a company like beefeater i would contact the wages and pay-role and advise them and they will look into this for you even if your details where not entered into the system they can sort it from there end |

In the US, I'm pretty sure you have the right to collect for the time worked PROVIDED you are a legal resident and have the right to work in the US. If you're an illegal alien, then you're paying the price for not entering the US legally.
First, I think you have to document the hours you've worked, dates, times, duties performed, and note any other co-workers who can verify that you did perform the work. Copies of a work schedule showing your assigned work schedule would be great.
Then investigate the Fair Labor Standards Act and find out locally about any workers' rights agencies in your area - city, county, state. I'd file a complaint with the local Restaurant Association and the Better Business Bureau. These agencies have no power over the owner, but it sure puts him in an unfavorable position of defending his not paying you. Also investigate the small claims court procedures in your precinct, county, or city. This may be your last resort if all else fails.
Lastly, if none of this works, contact the State Attorney General's office. They will send you documents to fill out in order to file a complaint with them. They will force the owner to explain his side.
In all these cases, send copies of all your proof and supporting documentation by USPS and get a Return Receipt so you will have proof of your complaint to that agency.

The company will probably not pay you and technically you don't have the right to get paid, but if you're unsure, book an appointment with citizen's advice. |

Absolutely! you should be paid for every hour worked. If your not getting it go to the citizens advice bureau they will help with the next step.
I have been in the trade for many years and am constantly disgusted with the way low level staff are treated, if everyone just lets it go, takes it on the chin and moves on this will not change. Fight not just for the money but for the principle, if you let them get away with it they will do it to someone else. |

Yes, you earned the money, and you are entitled to it. I say that based on US Law, so if you are elsewhere, you would probably be entitled to it, but would need to check on your own laws.
Contract? We don't have those basically, or they would have to keep you and you would be stuck working for them for certain time periods.
