Tarabeara | Does being fired from your job affect your retirement and 401k monies? |

Rich Madcity
No. The money paid into the 401(k) was your own. The only thing that might be affected is the empyers matching contributions. If you were not working there long enough, you may not be fully vested and could lose some of those matching funds, but that would have happened even if you changed jobs, not just because you were fired. |

Anything you are vested in remains yours. |

It sure can affect them: I was not fired I was laid off for ever, job moved to Brazil and this is what I am going through right now. To keep my medical coverage intact I had to take an early retirement, so I lost 28% of my retirement benefit to keep the medical, I had to start paying a serves fee on my 401K taken directly out of the 401K and I could not pay any more into it either. This forced me to rollover my 401K to protected it. Being fired you could loose your retirement package all to getter if you do not have vested rights in the package. You need to check with personal on that point or a union rep if you have a union, as for the 401K you can not loose that directly but they can charge you a service fee being you no longer work for them. That is why you do a roller. So it can really hurt your retirement plans. |

No, it isn't their money to do anything with, but you should look into transfering it into something like an IRA soon. You would be best off talking to someone at a bank about what to do with your money. |

you would have the vested benefit of your pension at your termination date - assuming you are vested they will provide you information on this - likely by mail - if it is a small amount they may offer to just pay you out (this will likely be taxable)
the 401 K belongs to you and is yours - including any match you have gotten - assuming you have met the time requirements to retain the match - I would roll this into an IRA at Fidelity. |

It generally does it depends what kind you had. If it was the kind that your employer feeds into that will not continue to grow. You might want to call and see if this is a plan that you can feed when you get your next job. It might be the kind that you can withdraw once you have been terminated. If so you will get penalties, but you can take your money out now if you need it. If they tell you it can remain and gain interest then just leave it there if you can. |

No it doesn't affect it aside of the fact that there are no future contributions from your pay. If you are terminated though you can remove your money or roll it over into something different. You have to have your former employer contact the company handling your 401K and update your status to terminated and then you can remove the money. you will have to pay the tax owed on it though. They will keep some of it for that but they usually don't take enough to cover the entire tax bill and they will take none out for the state tax bill. |

why wouldnt it affect your retirement? Without work, you wont have any money to retire on. And the 401k? Well, if you dont throw money into it, it wont really grow all that much. |

Uh, if you're not paying into it... Yes. |

Arinbjorn B
It really shouldn't, only if you've done something super-illegal. |

Bosco A
It does not unless you are not completely vested. Then the company will get the money back that they put in. |

ERISA says no. |

Sure. When you don't have a job you're not contributing to your 401k any longer. Also, since you don't have a job and will have a hard time getting one because you've been fired you'll find it very difficult to retire. Generally you have to be working to retire. You're essentially retired now... |
