Yes...when you file bankruptcy ALL your assets and debts are looked at per the new laws....you cannot pick and chose what you file any longer. |

Yes, they will do a search on any assets you own and trust me, a real property will show up.
A former business partner filed bankruptcy to get out of paying some debts. He had "sold" some investment properties to his brother to protect them and the court discovered this and he was charged with fraud. |

Sure, but how much of your property has a title? House, land, boat, car? Out of all of those, a bankruptcy court could only take the boat and the land. They are required to leave you with your house and at least one car.
I'm not suggesting this, but a friend with two cars filed for bankruptcy. He drilled a hole through the flywheel of his older car, and jut barely in to the engine block. He put a bolt in there so when the bankruptcy investigator tried to start it, it seemed as though the engine was seized up, so they let him keep it, and he took the bolt out and drove it for years. |

The purpose of discharge from your debts and to keep some of your assets. Don't worry, the creditors will come after the property you "forgot" to include in the schedule of assets. It is also fraud. I hope you would not "pick and choose" the assets you list. You feel the system is fair? Well, you should play by the rules. |

Yes, I believe so...
But if you own more then One property it doesnt neccesarily mean they will take both of them, or either of them.
I have a friend that just filed, with 3 houses, and due to the economy, bankruptcy didnt touch them...she owes more then what they are worth in todays economy...

Yes, they not only check on the properties you may own but they will check on your all incomes that you are receiving. They also make sure that you have not lied about anything. |

Yes, and then your name and address are printed in the London Gazette (I think, can't remeber now). Basically all the banks, IR CSA etc are informed and they will check you out too. |

Even should the court fail, the creditors won't.
Since you swore to the info. you provided, you
can be charged for trying to conceal assets.
(Fraud + Perjury, don't try it.). |
