Do u ever have a bill collector call u about some money u owe them?...and inreturn u do talk to them and make payment arrangements...then they tell u that they will note your account on the computer that they did speak to u and that u did agree on a certain payment plan?....But the very next day or 2 another person calls u from the same company and says u owe them money...but u tell them that u already spoke to someone about this matter...and it keeps on going day after day?... |

I did in the past but not anymore. I have learned the hard way when it comes to dealing with collectors.
First, Never agree to anything on the phone. Most collectors may not even be able to legally collect the debt. There are a lot of factors that play into it.
If you have never received a letter from the collector prior to the phone call they must do so within 5 mailing days of speaking with you.Once received you want to send them a debt validation letter mailing it by certified mail return receipt requested.
You want validation of the debt. Something that says you have a contractual obligation to pay them and not the original creditor. This is your right pursuant the Fair Debt Collection Practices Act (FDCPA).
"Validation is demanding that the creditor reporting the information prove to you that the account is really your responsibility, and that the balances, etc are accurate. In the case of collection agencies, they must also prove that they have legal right to collect the debt. They must STOP all collection activity, including reporting and verifying, until they supply proper validation to you after a written request. Although no time limit is specified for them to validate, they cannot continue collection activities until they provide such. Sometimes, Collection Agencies will stop collection activities and return the account to the original creditor rather than validate. (This is perfectly legal )" *see note
Also if you would like them to stop calling you, you can send them a limited cease and desist letter. With that you send them a letter that simply states that they do not call you at work or at home at any time. All communication must be in writing.

Yes! I had a place call and be rude and hang up on my wife, and I called the next day to complain and tell them it wasn't my wifes debt and to not be rude to hewr or bother her. The woman said that "No one here even called" which is B.S. - she basically called my wife and me liars, and then hung up on me! |

yes! it is a horror! i learned my lesson. i started taking note of the person i talk to and the time and date we talked. this way, they cannot deny it. but if it happens to me, i normally terminate my accounts with them. once, i cannot do so since it was a service monopolized by them. so i wrote to the local newspaper complaining about their bad service. there is nothing like bad publicity. |
