question asker | Does your employer have the right to not pay you until 11:59 the night of the first if you get paid on the 1st |
My husband's paycheck is always crazy. He'll get it sometimes at 2:00 or 3:00 pm or 8:00 am but sometimes not until the VERY last minute before the day ends. He's a pilot and it's crazy. Our payments that go out on the first go out midnight the day before but sometimes he doesn't get paid till almost midnight that night. Does the employer have ALL day and night or until the close of business to pay him? It isn't fair! They also don't provide pay stubs. My husband flies all the time (like weeks gone from home at a time)and if he didn't show up on time they'd be pissed but it's okay if moneybags doesn't pay my husband until his lazy assistant gets to it. Additional Details actually pilots USED to get paid a ton of money now the average airline pilot makes 20,000 the first three years. My hubby is a private pilot in a large jet so it's true he fares better but when in the airlines he didn't do so well. Also, pilots aren't paid nearly what they're worth. Their education is worth hundreds of thousands of dollars and it takes time and money (usually at their own expense, not a company's) to build up experience enough to be able to actually fly for the airlines that pay them crap. These professionals have many lives in their hands and they have to pay for experience that other professionals (doctors) get for free (during residency). A pilot has to know how the airplane works, all about the weather, keep informed of events in the plane, on the ground, and in the clouds all at the same time but yet people still feel the need to complain about their salaries. News for you....it's the CEOs of the airlines that make all the money. NOt the pilot. |

Some states, like CA where I am, require the payroll date and time to be posted. There are rare occasions when the checks don't get out at the posted time due to circumstances beyond my control. That doesn't make it okay, but as long as it doesn't happen often, employees usually understand. Even in states where there is no required time posting, if you contacted the Department of Labor, I'm sure they would agree that to be considered paid on that day, a reasonable way to cash the check without paying a fee has to be available (in other words, your bank would have to be open).
Check stubs are a requirement. Simply giving you money and saying it is your pay is not good enough. Another problem you may want to anonymously report to your department of labor. |

For your bills--check to see if you can move your payment date back a couple of days. That'll give you time to get the check in the bank. Also, look at all your bills, what the payment is, and what date they're due.
We have fairly big student loan payments, so I pay some of the other bills early--so they come out of the other paycheck each month. |

Unfortunately an employer has up to 5 days from pay day to pay his employees in some states .Check with your better business office for more information in your state. |

By law you just have to get the money on the date that the company says is the paydate. If they say the first they have until 11:59pm on the first to get it to you. |

If there is a company policy which clearly states these terms, the employer is within its rights to pay at anytime to till the last minute. |

Change your bills to automatically go out on the 2nd and you'll avoid this issue! :o) |

11:59pm is still the first, isn't it? Why is it a big deal if the paycheck is a few hours late? |

What do you mean they don't give pay stubs? I do believe they are required ,by law, to have your earnings , state ,federal and social security on a stub with your check? How do you know if those taxes are being paid? How do you know if they're paying what they're suppose to into your Social Security retirement account? Too many things don't appear to be right here.I would ask for a pay stub with the check and if you get one check with S.S. to make sure it is being paid into your husbands account. They'll know,They'll have all his records. I would check on this wether I got a stub or not. They're unwilliness to provide one looks fishy. As far as a time limit on paying wages employers usually have a set day and time for you to pick up your check.Your husbands employers are not being reasonable. There may be a law about that. Check your state site employment rules or dept. and go from there. After reading some answers I have this: You do get a weekly stub when you have direct deposit. That's what I have and I get one. |

You say that they don't provide pay stubs--does his pay get wired or direct deposited? If it does, then the issue is with the bank, not your husband's employer. If the employer has a large payroll, then they have to have the checks completed at least a few days prior to paydate, because of taxes.
Your husband needs to have a chat with his boss, if he gets an actual check, and explain that it would be helpful if his paycheck could be available in the morning. The alternative is to find a new job. |

Look into direct deposit. In fact, I think most people who have direct deposit don't get pay stubs either, but have to depend on the W-2 at the end of the tax year. |
