Ex Girlfriend used my debit card before i cancelled it, what can i do?
My girlfriend and I broke up, although i forgot to cancel my card, and she charged about $450.00 without my permission. Where can i go to get more information about getting my money back from her, if i have to, I'll go to small claims court.

before you do anything that involves the bank or legal action, ask her for the money. If she refuses, and you have proof that she used it without permission, take her to small claim court

You need to go to the bank and file a dispute for the charge(s) she made. You also need to go to the police station and file charges against her.

Get all the documentation that you can get. Inform the bank and ask what to do. You will probably have to go to small claims court. If possible, don't answer your phone if she calls to record it. Or call her and record it (if your state allows one party recording) or have a friend on the other phone to listen in as a witness. Also, I think I would inform the store where she made the purchase to get a copy of the tape of her charging the item.

You'll need to go about recovering the funds from her directly. The only exception to this rule may be:
1) She ISN'T on your account as a joint owner
**AND**
2) The transactions were processed as credit versus pin-verified Debit.

If the transactions were verified via the pin number, then you are considered liable for these charges, and the bank considers this transaction as one that you gave your approval for (approval was considered given when you provided your PIN # which is your responsibility as the customer to maintain as confidential).

If these were processed as though they were a credit card (ie: she signed your name fraudulently), then you may be able to file a claim with your bank, as they were unauthorized charges (IF she's not also listed on the account, of course).

However, your best bet may be recovering the funds directly from her. Contact her and let her know you know of the charges, and let her know you will take her to small claims if she doesn't agree to repay you that amount.

Be prepared with the account statement showing the charge, anything you might have to indicate that you know it was her that made the charge, as well as the dates of the break up and the charge. Best of luck to you!

Sorry to say but because you had in the past given her authorization to use your card, there is nothing that you can do.
A similuar situation happened to one of my friends and she contacted thre Bank as well as the Police Dept. and because she had previously given authorization (pin #) to the individual they would do nothing.

Your best bet is going to be to try to work it out just with her. If you broke up with her before she charged the account you can call your bank and ask them for options about it, but ultimately that might bring about some kind of lawsuit and give her a criminal record (theft or something of the like). Otherwise, small claims court is going to be your best bet. Actually, your best bet will be to threaten her with small claims court an hoping that she'd rather avoid taking a day off work and paying court fees (I'd assume you'd sue for those too, otherwise its barely worth it). You can just do a google search for small claims court and your state and you can probably get to your state's judicial website which will explain the entire process. good luck!

If her name was not on the card or if she did not have written authorization from you and on file with the card company she may have just committed credit card fraud/ identity theft.

Ask her for the money, or that you will have to report this to the credit card company and they will advise you.

Call your bank and say she stole it...they will either remove it all or some of the charge. Then call the authorities.
