Friend owes me over $2000, won't pay me back, and won't return my calls. What can I do?
My friend and I used to live in an apartment together, splitting the monthly rent. Every month, I would give him my half of the rent and he would pay it in total. However, for a couple of months, without my knowledge, he kept my half of the rent to help his own family pay for his cousin's hospital bills and hadn't paid rent. After a while, I found out about this through an eviction notice.

I quickly paid off the rent so we wouldn't be evicted and my friend said he would pay me back in October. I also quickly moved out as soon as possible because I knew I couldn't trust him anymore. Now that October has passed, he has not returned my calls and have not paid me back a dime.

I lost all the documents and evidence that I had if I were to take him to court (long story) and now I don't know what to do.

Please help.
Additional Details
Technically I didnt loan him money. He took my money without me knowing and I had to pay the outstanding rent to prevent eviction.

Unfortunately, you will probably just have to chalk this one up to life experience & write it off. You could still try small claims court as its a he-said, she-said kind of thing as to who is more plausible, but if he doesn't show up, even with a default judgment, you would still have a hard time collecting. Next time you do something like this have a legal signed agreement in place and a special checking account for communal expenses. And I hope this is an ex-friend!! Sometimes people just suck, sorry.

With no documented evidence you're pretty much screwed. Unless you can prove you were both on the lease and the transactions that transpired it's basically going to be your word vs. his and the judge will probably throw the case out... sorry

Without any documents to back up your story you can't take him to court..You learned a hard lesson..Just be sure to let everyone you know about him so they won't have the same problem.

For that small an amount, you sue him in Small Claims Court.

In Small Claims, you don't need a lawyer.

First of all, make sure the lease isn't in your name anymore (if it was) as he doesn't seem to be responsible and could ruin your credit.

I don't know how you could prove this. It will have to be his guilty concious telling him to give you the money back. I really don't know how you'd prove this in small claims court.

Take the loss and learn your lesson about loaning money out to people

Well. $2,000 is a lot of money. If he doesn't know that you lost all your documents, maybe you could bluff him.

Say "hey, if you don't pay me back, I will take you to court".

Leave him that voicemail, or you could just consistently call him. Why not find out where he is now and just confront him face to face with the issue.

I really think you may have to take a hit on this one. Where would he get the $2000 from? If he had $2000 he wouldnt have had to steal your money to pay his family members doctor bill. Maybe you can write it off on your taxes as a donation... Take it as a loss, and think of it as doing a good deed. It will come back to you one way or another.

Do you have a loan agreement with him?
It would be better if you did,but if he asked to borrow money from you and said he would pay you back,you have a verbal agreement,but he can always deny any verbal agreement in court.
You can take him to small claims court yourself and sue for the money plus court costs up to the courts limits.
You can still try to sue without the documentation if you tell the judge what happened or you can just chalk it up to experience and write it off.
I don't know if you can write the loss of on your taxes,you'd have to talk to the IRS.
If you can,then your friend would have to pay income taxes on the money he owes you.

Are those documents really lost or just misplaced in the move? Did you make backup copies? If all proof is really lost, going to make it harder to take him to court. I would count it as a lesson learned the hard way. Be more careful to who you lend money to and have a some from of document to go with it.

My husband knows what you are going through. Its smaller amount then yours, but a friend of his owes him and he knows at this point, he will almost never get it back.

u can take him to court if u r telling the truth and the jury belives u then thet will give him a certain amount of days to pay, and then u will have your money back, but remeber u must win the case
