I dont run any company i am just a simple working citizen. Have big debts because of not being able to pay for my loan. Can i make myself bankrupt to loose my debt problems?

Write to all of your creditors. Explain your situation and send them a copy of your income and expenses. (not including any debt repayments) List all of your priority debts (this includes rent or mortgage arrears and loans secured on your property, fuel arrears and anything subject to a court order.) and the amount that you pay each month towards these.
Then list all of your other debts. From the amount left over after the rest are paid, divide this figure between all of your other creditors fairly and offer them this as a monthly payment. |

The first step is to be honest with yourself. Is it really debt that you can't pay off or are you living outside your means? As a credit counselor, I see a lot of people that would be able to pay off their debts but are unwilling to make certain sacrifices needed to get said debt paid off. Set yourself up a payment plan and STICK TO IT! If this does not work, bankruptcy maybe your next option. Just make sure you learn from previous mistakes as to not repeat them in the future. Declaring yourself bankrupt is the last option as it restricts your purchasing options on many levels. If it was that easy and painless we'd all be doing it. As many have said get proffessional advice before you decide anything |

You can declae yourself voluntary bankrupt. It'll screw up your credit rating for life though. You'll never get another loan, credit card or mortgage unless you pay off all your debts.
Contrary to popular belief, declaring yourself bankrupt does not mean you don't have to pay the money back, you still do they just won't actively cahse you and send the bailiffs round.
Why not talk to the loan company first to see if you can work out a method of paying the loan that you can afford, that'll be your best option. |

the best thing to do is. look at your budget, look at your debts, which is most important, say will you be left in the street?. right, share out how much you can afford between them, if you keep paying the same amount every week to each, no misses, it will show up as your making an effort, down the line it looks very good on record, keep all your payment recipts. at the end of the day if you were owed a lot of money, would be happy to get a little each week on time.

You can sell your car and pay it off and any extra money can be used to payoff the bank(s), or you can do BK but that will stay on your credit for 7 to 10 years. Or you can try to apply for a presonal loan and try paying off your lenders that way. But you have to do a BK legally like through a lawyer, you can't just do it by yourself. |

You could speak to the lender. Sometimes they will stop any interest being added and set up a minimum payment which they decide/you agree on based on your current income and outgoings. This is a better way forward than declaring yourself bankrupt. To become bankrupt will affect your credit rating for the next five years or so and will potentially stop you from getting a mortgage. You don't know where you will be in the next few years, but it is likely you will want credit at some point. |

The 1st thing to do is contact your local Citizens Advice Office or Debt Councillor with your local authority. Making yourself insolvent may not be the solution. A lender would rather have a small percentage of something rather than nothing. The CAB can help you write to those you owe and arrange a payment schedule if possible. DO NOT under any circumstances contact one of the daytime TV advertisers like Carol Vorderman promotes. They are not the best solution. Good luck.

Yes, you can make yourself bankrupt, it will cost you £330.00 plus £150.00 for court fees unless you are in receipt of any benefits. You need to speak with someone about this the best place is probably the CAB, but as they are difficult to get hold of you can try contacting CCCS or Payplan, neither will charge you. They will go through your income and outgoings and advise you on the best course of action, because although you can make yourself bankrupt this does not necessarily mean that you will not have to pay anything.
