Have you heard how to get back the charges that your bank penalises you with ???
I found out recently that the when you receive bank charges for say missing a direct debit by not having sufficient funds in your account, resulting in receiving a letter which tells you you;ve been charges £30...putting you further in debt...well this is illegal !

You're allowed to go back over the last 6 years and claim back all the charges that you've recieved ! It's easy...write to the bank asking for the last 6 years bank statements (normally costs £10), add up all the charges then write to the bank asking for the money back. If they refuse, take them to the samll claims court wher you can add on 8% interest for each cost plus court charges !

I have just taken the Halifax to court for £4850 and won !

It is illegal for them to make the charges if they are a profit making business !
Additional Details
The Halifax did send me a letter telling me that even though they were refunding all the money it was not an admission that the bank charges are illegal (yeah right !), but it was not worth while them fighting the claim as it would cost them too much money. They also said that if i received any more charges they would reserve the right to close my account...and i'll reserve the right to take them to court again pal !

I opened another bank account before I started the claim, just in case !

wow...that is very interesting..must research that one to see if it is applicable to the States....

In any case, I simply called the bank in question and disputed the fees/ charges...since I was right and was able to proof my case, I have never had a problem having the charges reversed and my money returned...it's all about advocating for yourself !

Im currently in the process of getting back about £5500 from Abbey. I used a website :www.moneysavingexpert.com
Failing that just enter 'bank charges' into your search engine and you will get lots of choice. TIP : do it yourself. There are alot of companies who say they will get your money back, but they will charge anything up to 33% of what you get back

I heard about this on the news a few weeks back. Apprantly a lot of people have been successful.

However, there is danger that the banks will tell you to sod off and close your account.

I'm just going through this process myself. I got the statements from Barclays yesterday and though my charges only came to £760 I wrote the letter to them yesterday requesting it back.

How long did it take you to hear after you originally asked for the money back?

Did they make you an offer or just say no straight away?

I used the Which? website though I'm sure it's the same process.

Wasn't sure about the small claims court because I thought you had to pay for that. Going to look at the website you posted above though.

Thanks for the info. Also makes me feel more positive as I thought that it wouldn't really work.

yes I have, sue them and take them to court, they do not defend the case in fear bad pulicity and offer you full refund.

If you had £4850 worth of charges then I am surprised that you're not bankrupt by now. Why not just admit that you can't manage your finances and try a bit harder. If I were the Halifax, I would have closed your account anyway! People like you wind me up because you are never prepared to be held accountable for your actions.When you got the first charge, you should have learned your lesson and been a bit more careful with your money instead of burying your head in the sand. Sorry, just being honest!!!
