BMTS1211 | How do I get this debt collector to stop calling me? |
I just got into an arguement with a guy. I asked please stop calling me because I sleep during the day and do not appreciate them waking me up. I contest the debt and they said they will keep calling me until something is setup. I asked nicely and he said we will call until it is paid. How do I stop it. I have never had this issue before and this is horrible. Legal action should be able to be taken |

Just answered a similar question for somebody else.
Here's the deal. If you are contesting the debt because it is not yours, and you can prove it, go directly to the fraud investigators of the company that originated the issue.
(ie, Sears, Verizon, whomever....)
DO NOT attempt to deal with the collections agency. They will not stop calling you no matter what. It's what they do.
However, if you go to the originating company and speak with their fraud investigators, and provide them prove of your postion, the company will call off the collections agency.
As for legal action, the most you can sue a collections agency for is the amount of the collection plus punitive damages up to $1,000. I know that sucks!! But, I found that out through my own similar situation when I was going to sue.
If you're going to even mention legal action, do so directly to the originating company's fraud people. That does help to get them moving.
I did so and had my similar issue resolve within 24 hours.
You will also want to make sure the originating company removes this from your credit report and sends you written prove thereof.

You're right. Legal action should be taken. Against you for being a deadbeat. If you want the debt collector to stop calling, I suggest you pay off the money you legally owe. |

When dealing with debt collectors, people have certain rights that were given to them by the government and managed by the Federal Trade Commission. Debt collectors also have rights, and they must follow a certain code of responsibilities. |

Once you have asked a Debt Collector to stop calling ever again, even at work, they can't call you . I had a friend that worked for one of those places and she told me that if you tell them that, they may not call you anymore or you can put a law suit against them, this was a few years back, so say that to them and see what there response is. The problem is the legal action you are saying should be taken may be exactly what's going to happen ... they may end up just garnishing your wages and they're done with you. When you get a garnishment, they are allowed to take 25% of your income until they are paid and that money comes right off the top. Is that what you want? You can contest the debt but it's not up to the collection agency to resolve it for you. They are paid to collect. Contact the creditor to arrange payments or disputes or whatever. You may wish to get an answering machine because that collector will continue to call you day after day after day. How else can they expect you to pay them??? |

Disconnect or turn off your phone ringer during the day. Also, if you truly contest it, contact the credit bureau and in writing state it (to which ever report it shows up on). If they can't prove it is a valid debt, it has to be removed and that should then get the calls to stop. |
