The debt can be chased indefinitely and always remains owed. HOWEVER, this type of debt cannot be enforced in court if it has been unacknowledged for more than 6 years. Acknowledgment means either making a payment on the debt or a written acceptance of the debt.
From your question it is uncertain whether the debt is time barred being from 2002. If you are certain the time is passed then you should write to them pointing this out and ask them to stop bothering you.
If you are uncertain there is nothing to stop you contacting them asking for more details of the debt but you need to be extremely careful that you do not specifically or impliedly agree that the debt is yours. If you do and the 6 years has not elapsed you will re-acknowledge the debt and the 6 years will start again. This is sometimes a useful delaying tactic when the limitation period is due out soon.
If there is uncertainty as to what bit of 2002 the debt was acknowledged then you may have to play a game of chicken and hope it goes your way.
Finally at any time even years in the future the debt is still owed it is simply unenforceable. So they can sue you. If this happens you must respond to the claim (summons) if you do not then the debt can become enforceable again and you will have problems putting matters right

I agree I thought it was 6 years also, but do not ignore this now they have caught up with you or you will incur further charges etc and end up owing a hell of alot more than the original debt! |

i got a letter from an agency, saying that i owed money to Barclay's bank from seven years ago, i had never received any correspondence from them ether.
i think it is a scam.
some people will pay up so that they do not get a bad credit rating.
i phoned them at first and explained that i did not owe any money to them, but they continued sending the letters for about two months, then they stopped sending them.
just ignore them they will go away. |

as long as you don't pay them.... run and hide if you don't want to do that. |

I had the same problem with a phonebill from 1998. I just heard about it like a month ago. There is a statue of limitations in every state. Usually its 5 years.
If you get letters or phonecalls from them, do not respond.

This site gives you information about the Statute of Limitations (SOL).
http://www.budhibbs.com/statute_of_limitations.htm
The "time" varies from state to state. (Your state will be listed.) Too, the contract may state that the agreement is governed by the laws of a specific state -- therefore, you may want to also note the SOL of that state.
www.BudHibbs.com offers a lot of valuable info about Junk Debt Buyers. (Click on buttons across the top -- esp. "Agencies to Avoid" -- and be sure to read "consumer comments" if the agency bothering you is listed. His and many sites offer (free) Cease Communcation and Vaidations letters and explain how & when to use them.
(Bud is a Credit Expert.)
Let me know if I can be of further help.
P.S. There may be free or low cost legal service in your area -- call government agencies or visit their websites to find out. |

The debt expires under prescription of limitations after 6 years in England -5 years in Scotland.
This is from the last date of contact or if company prove they have taken reasonable steps to contact you it would start from then. Obviously if you try to keep dodging them then that would go against you.
Try sending a recorded delivery letter to this company with your belief that this debt is time barred but only if it's been six years (or 5 in Scotland). There are a number of cases at the moment where debt collection agencies seem to have bought "old debts" and are hoping you will pay up. Good Luck! |

Six years since you acknowledged the debt. If they write to you and you respond, it's acknowleding the debt, and it all starts again.
But don't run from your past! |

If your debt has been passed to another agency, they will keep chasing you till the debt is paid, or sell it on to another agency and they will chase you. If you owed the money, why don't you pay what you owe, and be free of the worry. |

They can chase you for debts up to seven years. You should go to your local Citizens Advice Bureau. |
