How likely is it for a collection agency to file suit?
I have some debt that I am struggling to pay. A lot of the collection agencies call at the last minut and tell me if I dont pay something "today" they will sue me. Its not like Im not trying.

IF they have ANY intent to actually sue, they won't tell you they WILL sue, they will tell serve you with papers stating they have ALREADY sued you. As a rule, if a collector is talking, they are lying. They operate by SCARING people into sending them money they need to eat. Next time they call, don't listen to anything they say. TELL them what YOUR terms are.

very unlikely they would do such a thing....too much time and money out of their pockets....it is a scare tactic.

i dont know why the other reported you. but try keying in the question other ways and see who already answered. i was always told if you pay something they cannot do anything. and i would change my number if i was you. when they call and ask for me i tell them they are dialing the wrong number and that i have been telling them that for the longest. and eventually all the calls stopped.

The more the debt is over $1000 dollars the more likelt they will. I've seen them file for $900 and do nothing for 5K...they will pull your credit and weigh the odds....if your credit sucks, 530ish & below they know you're a dead beat and the chances of getting any cash is highly unlikely.

When they contact you VIA mail....make them validate the debt...they MUST prove it's you that owes the money...many times these slime balls can't validate and they MUST take it off you reports within 30 days.

just depends on the company if its credit card then your fine.

Most collectors try to scare you into paying by making everything sound and seem worse with out actually saying it.

the only thing you really have to worry about is getting a credit card and then never making a payment cause that credit card fraud.

It's a tactic to say that you have to pay 'today' but you should sit quietly on your own and work out how much you'll actually manage. Then write a letter to each one with that offer, and if they accept it set up a DD that goes out to each one just after you've been paid.

They can't send bailiffs in without a court order. And as it happens I know a doorstep collector socially, and they're very nice, constructive people, not thugs. If you get a visit from one it'll be less stressful than the phone calls can be.

You can't pay what you can't pay, but do try and pay what you can.

Those guys are jerks!!!! Half the time they pick on innocent people. They're a lot of talk. I'd say there is a small chance they'd sue. They only get like 33%-50% of what they collect so it wouldn't be worth a lawsuit.

Personally I'd file for bankruptcy (unless I lived in America, as I'm unsure as to what the rules are over there).

what you need to do is set up a reasonable payment plan with them!

they will OFTEN threaten to sue as a scare tactic but as long as you regularly pay they will not.

Tell them that if they don't stop hounding you will seek the protection of the courts and file for voluntary bankruptcy. That will mean they will receive nothing.

It depends. Often collection agencies tell you that to scare you into paying them. Depending on how old the debt is, and the amount ( I would guess $1,000 or more)they may or may not sue you. Never admit that you owe anything, and make sure that you request for them to provide you with information (proof) that you owe this money. Also make sure the statute of limitations isn't up in your state. Here in GA its 4 years a company has to collect a debt. After that you can send a certified letter asking them to stop any further collection attempts.

it's unlikely that they'll sue you, but they can do so at any moment without prior notice to you. Just keep making the payments and they will most likely leave you alone except for a few phone calls and letters.

Dude, they will and can sue you and don't even need to tell you before hand either. If they sue you and get a judgement they can garnish your bank account, wages and even put a lien on your house. But if you make reasonable (like a 100 per month) regular payments then it should be cool. I don't know how much debt you owe you can do the math on "reasonable", reasonable is NOT 10 bucks per month...but pay on time every month and you'll be cool.
