Strickly speaking 6 months... I come across situations like this all the time, but there are three ways around this.
1. Ask the bank manager to phone the issuer to confirm that it is ok to cash the cheque if it is a large amount, which both parties should not have a problem.
2. Ask the issuer to initial the cheque and re-date it, which is easily done if you know the authorised signatory. (possibly getting them signing the back also can help)
3. They can reissue it.
PS:
Please note if you hand it into the banking system, you may find somebody doesn’t notice the date AT FIRST, but the cheque goes around the clearing system for up to five days, and eventually it will get noticed,
PLEASE NOTE: at this stage any funds that they had credited to your account will be taken back and they will charge you for the privilege! And also this will make it harder to get it reissued!

If there is no expiration date on the check itself, I would try to cash it. As long as the company does not have a policy regarding this, it should be fine. Not sure where you live, but there could be law covering this area. Good luck, hope you get your cash! |

Well this just shows how urban myths are promulgated.
The time limit for a cheque as a negotiable instrument is six YEARS.
The banks impose a time limit of six months, not the law, and if the cheque is more than six months old, insist that they honour it. If they don't sue the buggers.
In practical terms all they can do is refer it to the drawer, who can then dishonour it, so then you sue him on the instrument. |
