zali6 | How should I deal with Chase after they lost a deposit that I made? |
I made a deposit via the Chase ATM in my Bank for checks worth almost $4,000. Days passed and the money was not added to my account. After I complained and showed them the ATM receipt they added the funds and apologized.
But then I received a letter from Chase that the money was taken out of my account because they couldn't locate the deposit envelope. When I called them they said that I have to provide copies of the checks, which I can't of course because the checks were never cashed and are rotting in a chase basement somewhere.
The other option they gave me is that I contact everyone that gave me a check and ask them to write a new check, but those people are requesting 30 dollars per check to stop the original checks.
Two of the checks are my tax return money and I don't know how to contact the IRS and my state's (NY) tax agency.
The main issue here is that Chase is acting very rude and unprofessional. They should compensate me for all the trouble.

I used to work at a bank as a personal banker and I have seen a lot of confusion and deposit problems.
I know how you feel and it is extremely frustrating. Unfortunately, there is so much account fraud, kiting, and ATM fraud these days that banks have to cover themselves. It is quite easy for people to be sneaky and deposit envelopes that are empty or simply not putting anything into the ATM at all, to try and get free money- this is why it is so difficult for you at the moment.
I suggest to contact the IRS- http://www.irs.gov/localcontacts/index.html
Find a location near you or call the 1-800 number on the website. Let them know your situation- they will work with you.
Also, it will be worth getting those checks again. Let Chase know that when you do have the proof you expect to be reimbursed for the money you will be out. There will be someone that you will eventually talk to that will meet your demands- especially if they lost your deposit. If you are still having problems, talk with a lawyer.
Also, from now on I would definitely walk in to make large deposits like that... it is always better.

Well, they have an electronic footprint when you made your deposit, you have also a copy of the receipt when you made the deposit. I will suggest to go sit with the branch manager from the ATM you deposited the money. And have them look at their deposit records for that day. |

Well, I absolutely completely disagree with this. The receipt only shows that you told the ATM you were putting $4000 worth of checks into the machine. It does not prove that you actually put $4000 worth of checks in the envelope for deposit. You could have actually filled the envelope with blank slips of paper and the receipt would still show you deposited $4000.
Talk the bank manager at the branch where you made the deposit. Have them double check the machine and make sure that your deposit envelope is not stuck inside the machine somewhere. If the machine malfunctioned, it's really hard to tell where the envelope could have ended up on the inside.
If they don't find your deposit, then you need to speak with whoever is in charge of the ATM. That could be bank/branch manager or it could be someone at the main office of the bank. That means that the person you need to talk too, will not necessarily be a local person that you can sit down with. It may be someone who works at the bank's headquarters in another town or even another state depending on the bank. This person will be able to look at the records for the ATM for the date that you say your deposit was made. They will then be able to compare your ATM card number with the numbers that show on their list. Still, this does not prove that you put $4000 worth of checks into the ATM but it does prove that there should be some type of transaction for your account for that given day.
If after this, you still are unable to find your deposit, then you can either pay the $30 a piece for the checks to be reissued or you can speak with an attorney.
I'd also like to suggest that you are very calm and nice with everyone that you deal with at the bank. The more you yell, scream, threaten, and show your rear, the less likely the employees will be to help you. That's when you start being bounced around between 100 different departments with nothing being done about your problem. Good luck and I hope you get your $4000 back. |

Ok, this sucks big time. I think it would more beneficial for you to have everyone enter a stop payment and issue a new check.. Regardless of the fact that it is a 30 dollar fee per check...I would rather spend 300 bucks to get my 4000 back. BTW after all that clears CHANGE BANKS. |

This is the third time I heard of a complaint about Chase. First off the bank is being ridiculous. Isn't the receipt enough. How is it your fault that THEY can't find the deposit envelop? It's not your fault. I'm sorry but If you don't want to go thru the trouble of contacting the IRS and paying the people $30 to re-issue you new checks I'd sue. (Though that may take you a while). Call your States Consumer Affairs Helpline and see what they have to say...but this is ridiculous. |
