I'm a Full time worker and my hours was cut to 20 per week. Can I apply for unemployment?

dezbah1911
I've never filed for it, but I'm under the initial impression that you cannot. You'd have to be laid off completely. Just to make sure, go to the government's website (wage and labor board). It should give you the correct info.

Pretty long response based on my knowledge.

It depends on the state. Anything less than full-time you could qualify for unemployment. Full-time based on your company. Some company's consider 38 hours a week full-time; but most states will consider 40 hours full time.

There are a few things in consideration
1. Reason for separation
2. Earnings for the last 4 qtrs and number of weeks work
3. Earns per week

1. Reason for separation is not a problem as long as you did not refuse work. Your employer reduced your hours.
2. Earnings. Unemployment is calculated by taking that last 4 calendar quarters (every 3 months, Oct-Dec, July-Sept, Apr-June, Jan-March) and using those wages earned to determine what you unemployment weekly amount will be. (People are sometimes thinks it is based on their current employer if they had recently changed jobs.) In addition, the total number of weeks work will determine how many weeks you can collect benefits. (This is very important so check with your state. For the qtrs I outlined aboved the weeks worked would be about 96, if you worked only 50, this could effect number of weeks you can claim benefits.

When you file your claim, you have one calendar year to use those funds. If the funds are collected continually, it would amount to about 6 months worth of benefits. The number of weeks worked can reduce number of weeks you are eligible to receive. (Another good question to ask)
3 Earnings per week from reduced hours. Once your weekly benefit has been calculated the current earnings will be subtracted and you may received the difference. There are maximum amounts for benefits and your part-time earning will reduce the weekly unemployment amount

Example

Wkly unemployment 600
Earned 200
Benefits 400

Unemployment is basically since it is regulated by the feds but there are specific state requirements. Go to your state's websites to find more information. Also, make sure you are clear if the benefits you receive are taxable and if the taxes can be taken out. You would not want to get screwed later.

Also, some people do not like to file for benefits while working for the employer. These are your benefits and you have every right to file for them.

I hop this helped Good luck

yes. you will be assessed on the average earnings you were making per week prior to being cut to shorter hours and they will most likely supplement it by a percentage. Hey, any money is better than "no" money.

Lola
I don't think so. You may just need to pick up a second job.

TedEx
Possibly. Some states ( Pennsylvania is one) allow you to work part time and still collect a partial benefit. the only way to find out is to apply and see what happens.

unemployment is mainly for those who have been laid off. getting hours cut is not the same as being laid off or unemployed. so the answer is no. if you need to make up for those hours, especially money wise, look into getting a part time job somewhere.

doug-ster
it depends on your state law. i know in PA you can because i have a similar situation, and have got partial unempolyment. @ least i believe it depends on your state. if not then u can get partial unemployment.

Mishell
no because youre not "UNemployed"

James O
