I'm being sued by a friend for $2000 but no contracts or agreements were made, should I worry?
Hi guys, so my friend let me borrow $2000 last year, we did not make any contracts or agreements. As a good citizen I told my friend that because of my financial difficulties at this time I would repay as soon as I graduate school which is in about 6 months. My friend agreed that she understands and will wait for my situation to get better. She now is suing me for those $2000, should I worry about anything or does she not have a case. She definitely betrayed me!

Unless you already paid her she definitely has a case.

Bring any proof of payment you have, that is the only thing that will matter, if you repaid her or not.

This is your problem, you do not deny you where loaned the monies just dispute the time table to re-pay, as such it sounds like your friend has a different opinion on when and how you where to repay the monies, as such it sounds like a judge is going to decided how and when you should pay the monies back

You had a vebal contract. She is entitled to the money. If you are honest and go to court the judge will see it that way. However, the judge will also see that you can not get blood from a stone. If you have no money, you can not pay. He may enter a judgement against you, but there is nothing to lean or attach. So realistically there is no reason for your freind to take you to court because she won't be able to collect for another 6 month anyway. My suggestion, settle out of court (save court costs)...work something out with her. Put the $2,000 on your credit card, borrow it from your parents.....just settle with her and deal with it. Lesson learned.

If nothing is signed, then legally or she will be hard-pressed to prove you owe her the money.

Be sure and show up or she can get a summary judgment against you. Furthermore, do not lie in court as that is almost a sure fire way of ending up in worse trouble than you are right now. Remember that anyone can sue anyone for any reason, and that very often it is more expensive to fight your debts than pay them off.

While you say that your friend agreed to the terms that you've outlined its clear that she does not feel that you are good for your word. It might be a good idea to contact her and try and settle out of court by offering a signed contract stating when he will repay her.

You have a responsibility to pay her back.
She has a case.

You betrayed her.

She loaned you money and you have not paid it back.
You owe her repayment in a timely manner. Not when it is convenient for you. Not when you feel like it. Not when you have nothing else to spend your money on.

So live up to your responsibility and pay her back.

Why aren't you making her payments? She can sue you from successfully from what you wrote. You admit that you owe her money.

Well you betrayed her by not paying her back when you promised. She figures this is probably the only way to get her money back. Unless she has more evidence that she loaned you the money you may be able to get away with your scam.

depending on where you live.. some verbal contracts do hold up.... in court, its agreed there was a verbal agreement... in general, i would say no... nothing in writing, dont worry its word against word...

tell the judge that she is lying and actually owes you about 2000 that you would love to collect but thought that your friendship was worth more than that. just goes to show if you don't have cash for something, you don't really need it. period.
