I am broke!What should I do about a credit card debt?
I have lost everything due to a costly divorce . I have tried to make payments on one remaining card in the amount of $13,000. Now they have sold the debt and have served me with a lawsuit demanding payment. I do not own a car , I make $1000.00 a month .My intentions were to pay something at least until things turned around. Should I declare bankruptcy or take my chances in court? I have absolutely nothing they can sieze.

Let me appologize on behalf of the answers community for the awful answer you have gotten so far.

You should try and avoid bankruptcy if at all possible. Your credit will be ruined for 7 years which will make it hard to get back on your feet.

Your best bet is to find a way to pay off the loan. I know that sounds impossible, but you can do it. Do NOT go to a debt consolidation company. They will not help much. They will charge you enormous fees and try and "settle" your debt. This cost you more than paying it off yourself and will also hurt your credit score.

Your best option would be a personal loan. Do NOT accept any offers from individuals to loan you the money, especially from YAs. They will ask for some kind of upfront service fee and you will never hear from them again. Going to the bank is probably not an option either since it is very difficult to get a personal loan from the bank these days with the credit crisis. If you have a credit rating above 680, then you might want to try social lending. It is a way to get a personal loan without having to go through the bank. Being a former collections officer and just hearing your situation. I think the best option for you at this time would be Bankrupcy. But keep in mind this will stay with you for 7 years. If you are still willing to pay your debts I would set up an appointment with a Debt counselor or set up a consumer propsal to help you find your way out of this mess. You have to way which way you want to go. Good luck.

take your chances, legally they ahve to leave you with enough to live off of, AT MOST they can take 25% of your check, but if you only make 1000 a judge wont' even grant them taht much...

how is your credit?
if its already bad you might as well declare bankruptcy but you need some money to do that
but going to court will cost money but a think they tend to settle for less because going to court for credit card companies doesn't tend to work out
find a lawyer or financial planner for further and better advice for you situation

Take your chances in court and have them take small garnishments out of your check weekly! Don't file bankruptcy!

Usually once an account goes to collection, they figure they will never get the money. & they HATE being ignored. Usually if you call them & set up something they will work with you. Most of the time you can tell them that you don't make much money & you can only pay them $20 a month & they'll take it because it's better than nothing. If you go to court, the judge can allow them to take whatever you owe directly out of your account. I know someone that owed like 8000 to somewhere & he only pays $10 per month & they take it because they know if they don't they probably won't get anything.

Declare bankruptcy fast. They are trying to get a judgement on you and if they do filing B/K won't get rid of it.

how do people rack up double digit credit card debts?

Bankruptcy is not gonna do nothing for you, your still gonna have to pay back, just talk it over with them, if it goes to court, it is still better than filling bankruptcy.
