On June 16th I will be hiring a lawyer for bankruptcy and now I am getting REALLY nervous. I know that this is the course I have to take, but I am afraid they will take everything. I don't own a home or a car, but I don't wnt them to take my collectables or my houshold items. For anyone out there that has been through this...any words of encouragement or wisdom. I am a little scared. Thanks. Additional Details I am filing because I lost my job and things just starting snow balling. I am a very responsible person, just things happen. |

Well, first off - it's not as bad as you think. I filed back in 2001 and also didn't own a house or a car. The whole court process took literally about 10 minutes - they ask you if you own any businesses or stocks - stuff that some people probably try to hide. And that is basically it. Although you have to tell your lawyer (and be truthful) about assets you have, they are not looking to take your collectables (unless they are worth thousands). I listed some jewelry I had and some other things I had. But seriously, they are looking for people who are trying to hide things - not people who just got in over their head.
I am certainly not proud of filing bankruptcy, but it did give me a second chance. I have since gotten ONE credit card - the offers will start pouring in before you know it - and I make sure I pay the entire balance every month. You will need to start re-building your credit after this and be prepared to pay high interest rates for credit cards and loans.

Relax. Most items of the nature you mention depreciate so fast, they wouldn't be worth reselling. They are valuable to you, but in truth they are not really worth much - unless you just bought a $5,000.00 television yesterday. (I'm assuming you mean these items are all paid for, and you are talking about unsecured debt. If any of the items are financed, that could be different.)
I haven't been through it, but i know people who have, and I've picked the brains of a few bankruptcy attorneys. It'll be okay! |

Sorry you got caught in the money trap. Bad things happen to all of us. Dave Ramsey has a really good plan for staying out of debt; he is awesome. His system is worth a try.
I know you are probably tired of advice, but his plan is the one.
My advice: stay away from credit cards. Cash only-bargain buy,stay away from the mall, think cheap. |

Most of your things are protected under the B/R exemption laws.
B/R stays on your credit record for ten years.
You sound judgement proof to me. If you have no wages to garnish. See if you can work it out with your creditors. |

Learn your lesson :) Also, don't go down the same path. Everyone will offer you loans after you file bankruptcy (people will come out of the woodwork). This is because they know that you can't file again for a certain amount of time.
There have been corporations such as Sears that I've known to come in & take big ticket items but otherwise I think you're safe (unless you have a lot of big ticket items from name brand stores that you got on credit). |

You've shown such excellent judgment! Gimme a break. I mean, sure, it could be that you couldn't help it, like about 18 people every year, but I'm willing to bet that isn't the case. I hope they take your computer. |

I would say the bankruptcy thing should only be a last resort. It's very bad for your credit score and stays on there for 7 years. I was close to declaring bankruptcy, but went to a consolidation company. They will help get you on your feet. It was a long process, it took me about 3-4 years to recover, but it wasn't nearly as bad on my credit report as a bankruptcy would be. If you decide to go the route of bankruptcy, you are looking at a life of cash payments for everything so be prepared for that. It'll also effect whether you can get a cell phone, a new car, and a place to rent. Be careful and good luck! |

The Chapter 7 bankruptcy is applicable if you have no regular sources of income. It works by reducing or clearing off all your debts. You can then make a fresh start without having to worry about having to pay your debts.
Once you file for Chapter 7 bankruptcy, the bankruptcy court assigns a trustee who works as an intermediary between you and the debtors. He oversees everything and checks out if the bankruptcy plan is going as planned. |
