Normally the amount of tax due on ones estate is decided through the probate process. The amount of tax due is very much dependant on the size(value) of the estate. If the value of his estate was large then there no doubt that tax will be due - unless gifted many years before death. Contact your probate office and get copies of the information books they provide this will give you details on how to approximate the amount due, assuming you have a good idea of the overall value of the estate.

no only on $100,000

You may have to pay it but if you leave it untouched in a bank the interest will pay for the tax.

I think you can only be "gifted" £8000 tax free...

There is no gift tax in the UK.

You are confusing Inheritance Tax which might apply if the entire estate was over £285,000.

In that case you might have a liablity of £30,000, less the allowance of £3,000 = £27,000 on which 40% tax would be due.

Gift tax is for gifts.

You will have to pay inheritance tax.

Roy
Inheritance tax is payable if the total estate exceeds £285,000 in the UK, and payable only on the excess of that figure

The Annual Gift Exemption (Applies to the UK)

There is an annual gift exemption of £3,000. There are special exemptions for gifts to children in the year they marry, as well as other special exemptions too. I wouls seek professional advice chances are you will need to pay some tax on the money.
