I have $40,000 in credit card debits. what is the best way to get rid of this.?

I can't file chapter 7 because I am partners in a small grocery store ( that is not making money). Also I can file chapter 13 but have to pay the lawyer $2,500 up front, which I don't have and still have to pay a certain amount over 5 years. the problem is I am working under the table and the judge wouldn't see my income and allow me to file Chapter13 or 14..Please help me with this..thanks
