I have a shared account with my fiance, am I able to sign his paycheck and cash it?
Like I said, I have a shared checking account with my fiance. He's currently incapacitated... He is the breadwinner for our little home, am I able to sign the checks and cash them? deposit them?

Asking here rather than a bank rep because we need it asap and the hospital he's at is 3hrs from our home... I'd like to know before I bother to try and pick up the paycheck from the house.

it really depends on what conditions you opened the account with.
if your signature or his are good enough say to write a check, it should be o.k. but some ppl set up accounts that need 2 signatures for anything.
on the other hand - depositing a check usually requires the person who it's made out to - to sign it.
you can sign in his name and deposit it and where I live it's possible to deposit a check w/o signing it - they stamp it with "account credited" - i don't know if that exists in your country or whether it has changed since all the money laundering changes went into effect. but if you are a co-owner of the account and show i.d. i don't think you will have a problem with it.

You can deposit anything into your account. You can also cash his checks. He has to sign it first and then you sign below his signature.

Well, I have two answers. HE can sign it and you can then deposit and cash it from there. That would be the proper way to handle it. Assuming these are payroll checks you are talking about. On the other hand....

There are times my husband sends me to the bank and then forgets to sign his check... so... I sign his name on them. Yes, it looks like his signature and the bank doesn't know the wiser. Is this legal? I'm not sure but as long as he doesn't care it works for us

Its not legal to sign his name for him. I know some people do it but its really not legal and if the bank pays close attention to signatures, they will see that its not his signature and think someone is trying to commit fraud or identity theft.

You can. It's not legal.

Having the same account simply means that your money is held in the same place, it has nothing to do with how the money gets there.

Legally, any check made out to him must be cashed by HIM.

No you can't ,the check can only be signed by the person it's written to,

Technically-speaking, No. He is the only person, by law, that can endorse a check in his name unless he has previously signed over "power of attorney" to another. Once the check is endorsed, I'm sure that the bank would allow you to deposit it, since it is a shared account.

Now, I should advise you that it is against the law to forge another person's signature on a check, and that if you suspect that someone is doing this, you should immediately report them, because a bank will generally NOT check or verify a signature on a check unless someone alerts them to suspicious activities.

You can DEPOSIT it not cash it. ONLY if HE signs it. Without his signature you can do nothing. If he is totaly incapacitated you can get "power of attorney" over him. Call a lawyer for that.
