Contact your creditors and explain to them the situation, and that you want to continue to make payments, but cannot pay the usual payment amount. Some will let you get away with only paying the interest amount, others will be more hard-nose, but when push-comes-to-shove they really don't want to get nothing. Let them know you are looking for work (hopefully you are) and find a job quickly! |

Never hide from your creditors. Contact them and try to work out a deal. These people don't want to spend bunch of money to take you out to court they would prefer to get something out of nothing, especially if you don't have a job.
Look for a job as fast as possible. Apply to Starbucks (just an exapmple) to get part-time job with benefits while you still looking for a real deal. :) It might take some time to find a good paying job and you need to have spending money to survive. I've been there done that.

credit card companys differ.
with each of these companies you will need to speak with one of the representatives, they usually will accept payments in the amounts you can afford to pay merely because they want their money!
Also they take into consideration how your credit is and how long you have been doing business with them.
Most credit card companies provide all clients with insurances offered during the pendancy of the card holder account that insures your credit to remain established in this type of case! As well as if you were hospitalised.
You want to know if they will take you to court? Well usually they do not take anyone to court. It is possible of course.
You should research the federal laws pretaining to debt. I believe one constitutional amendment states clearly that you can not be imprisoned for debt in america, this has been amended and the laws now state if your making "any" payment and have proof thereof that you have been making as much payments as you can that these companies are compelled to accept this, by law.
On the other hand, if they can prove that you are not making "all that you could have" then action can be taken against you for failure to make payments.
How much could your payment be anyways? Most credit cards I use have me paying 25 dollars a month against mny balancein the thousands. Maybe your in a terrible credit card rate? You can preserve your credit if you make attempts to pay as much as you can, make sure that you keep a proof of every payment that you have submitted, if they do take you to court, the judge will find that this is all they can do, they are aware of this fact as well and if your making payment and keep copies of your records then they can not do much to you.
On the other hand if you own asset's these things can be held and they court will most likely compel you to sell these items (such property items and/or personal) to pay off the balance owed. Similar to any debts owed that have been taken to court.
If you know anyone that has been taken to court over child support negligence they can easily explain what happened to them in court! It is very similar, each state codes differ, so check with those people in the state inwhich you reside. |

You will have to ask the creditors if they will take small payments. If they refuse and take you to court, and you tell the judge that you made them an offer and it was refused, the judge takes a dim view of this and will allow you to make small payments but a bit smaller than what you offered the creditors. If you make an offer, make it in writing and keep a copy . In case it should go to court, you can show the court the offer you made. |

Check to see if the have a Hardship Program. Most of them do and they could discount the amount owed as well as waiving fees and taking smaller amounts. |

Creditors will prefer if you pay them in small chunks rather than not at all, (I have seen this on debt management programme) if you write to the company and explain that you can afford the current rate they are charging you and they will most likely agree to allow you to pay smaller amounts.Try the website listed for more advice |

Firstly, do you have property, "real estate", ie.a house? If not, as you are not working, you do not have much to worry about except your future nil credit rating. The point is , in this country you cannot be imprisoned (these days!) for debt AND, if you are skint then no-one can make you pay! If you have lots of debts then my advice is to go to the county court yourself (your nearest one is online!) and ask to "MAKE A COMPOSITION WITH MY CREDITORS". Try it!! |

creditors wont take you to court unless you owe then a ton of money but if you do call them they will work something out just to get anything from you and if possible get a job to help pay it off even if it is a part time job. but use the money to pay off your debt. |

If you are from the UK... the last thing the credit card companies will do is take you to court. They will certainly try and pressure and hit you with interest if your card was not insured against unemployment. But it is possible to have this frozen and make fixed payment eg £1.00 per month until you can afford to start paying again.
Book an appointment with the Citizens Advice Bureaux for debt advice. They will write to the bank/credit card company on your behalf. |

If your in the UK the best thing to do is to let them take you to court and explain your circumstances - you could get away with paying about £2 a week if your clever!
Your other option is contacting the Citizens Advice Bureau who will put you in touch with an agency who will arrange an amount to pay to your creditors |

or
go to court and pay court fee's (running the court for the duration of a trail or hearing is around £3000 per day (you WILL pay a portion of this!!) AND pay your original debt and criminal record..
oh and if you don't pay you will be in "breach" of a court order!! and could find your self in one of HM taxis heading one way to Prison and it's not always local,if your nearest prison is "locked out" you could find yourself 300 miles away....which means no visits (no one wants to travel that far for a 30 min visit!!
i hope this has scared the **** out of you enough to realise that paying your debt now is probably the safest and easiest option!! |
