If you own your own house then they will take it from you.
You will be bankrupt for 3 years and after that debt free (scotland) !!!
If you earn above a certain amount a percentage will be taken from your wages to be divided between your debts.
If you come into any money in the 3 years that will also be taken.
Everything you need to know will be told to you by your lawyer or who ever is advising you on your sequestration.

First forget all the judgmental answers and take only the advise that helps.
Go see an attorney that specializes in bankruptcy. In most cases the first visit is free and he or she can explain all the steps you will need to take.
There are new laws covering bankruptcy and you may have to go through credit counseling first.
Understand that today's economy has caused many people to seek bankruptcy as the only option remaining to them. Critics should be careful on advice because they could end up in your shoes. Whether it be by an illness, accident or any other condition beyond their control. |

Dont go bankrupt as it will take at least 5 years for you to be able to get any sort of credit and that bankruptcy takes years to get it off your files (black list) the best thing that you can do is make an appointment with your bank to have your account consolidated, that way you can put all your depts in one place and be able to pay back this loan at an affordable cost. only go to your bank for this and not yellow pages. but if you do this through your bank they can keep an eye on our account for you and give you all the help they can, you must have a little income to be able to survive, go and ask for help they wont get you deeper in debt but they will help. |

Going bankrupt is not a decision that you should take lightly. There may be other ways of managing the debts.
Go and see your local Citizens Advice Bureau immediately and get advice as to the process, benefits and disadvantages of bankruptcy. Also ask them what other options there are to help manage your debt situation.

going bankrupt is a serious thing to do i sympathise have u thought about debt management the consumer credit counselling service really helped me as i was thinking bankrupcy but arranged small payments to each creditor each month it costs about £250 to go bankrupt and you have to apply to the court the consumer credit counselling service will advice you about wether bankrupcy or arranging a payment scheme is the best option for you. I know someone who filed bankruptcy and it was around 1200-this was in the us(pennsylvania) you will really need to talk to a bankruptcy lawyer and see if you even qualify or why not check into a settlement company that will allow you to pay off your creditors for a lesser amount(this happens once they go to collections) hope it works out and ignore these judgemental people! |

Hiya Hun, have been considering this myself for the last few months, so have found out quite a bit of info that might help you. The cost is £330.00 plus £150.00 court fee, court fee is waived if you are in receipt of any means tested benefits. You will need to arrange a new bank account after bankruptcy as yours will be frozen. If you have no assets and no "spare money" the bankruptcy will prob be discharged in under a year. They can only take items of value from your home, not things like your bed etc things that you need. Once the bankruptcy is discharged you are no longer liable for your debts so your creditors cannot chase you. I would strongly advise you to call CCCS to discuss your situation, they will be able to assess your financial position and if they find that your best option is indeed bankruptcy they have contacts for charitable organisations that can help you with the bankruptcy fees. I hope this has helped somewhat, try not to feel so bad, bankruptcy has increased ten fold over recent years and will continue to do so, being in debt is not a crime and no one knows what the future holds and no ones position is guaranteed, it can happen to anyone. yea, this is why you should have kept business long enough to sell all or part of your business or even make an LCC. Limited Liability Corporations can not lose personal assets that are not linked to the company, such as your house. |

I'm not sure why the creditors shouldn't get your house, at this point. Creditors will of course come knocking - you would, too, if someone owed you money and stiffed you.

I am sorry to hear that you feel the only option is bankrupcy.
Not sure why people let things get this far though. My husband and I are skint, but we do everything we can to make ends meet. We make cut backs when we see that things are slipping and get ourselves back to an acceptable level.
But what I don't understand is you say that you can't take a second job because of health reasons. Well if you can work part time why can't you work full time?
I get a feeling it is because you would rather have other people pay for your debt.
Be an adult and take responsability for your actions. Get a full time job (I clean toilets to make ends meet) and reason with your creditors.
