The only sure way is do not lend him any money. If you do lend him money, then there's no way to make sure he repays you while you two are still together or after break up. If a bank wouldn't lend him money, you shouldn't either. Even if you have a legal written contract drawn up and both of you sign it, if he defaults and you sue him and win a judgment against him from court, if he doesn't have the money, you still can't collect. That means you kiss your money goodbye. My advice, never lend money to people who can't get loan from their family members and banks, I don't care what their sob stories are. |

you better get it in writing and make him sign it and scan it or find some way to document the date it was signed. I wouldn't put up a loan for a man that wasn't my husband. I'd make sure he know I wanted my money back ASAP, but that's just me. |

You need to make him sign a promissory note with all the specifics and when you get him to sing it do it at the bank so you can get a notary to stamp it. |

You need to draw up a formal loan agreement that specifies the amount, interest rate, payment terms, recourse for non payment and have him sign it and you sign it and have it notarized. You might want to add a penalty for late payments and a provision to recover collection costs. |

If he doesn't pay you, you will have to go to court. Small claims court if it is under $5,000.
What you need to do is to get it in writing that you loaned him the money. In this document, you must specify the amount loaned, the date of the loan, and how he will repay you (e.g. monthly payments or a lump sum after a period of time). You also need to sign the document and so does he. You can get this document notarized or not that is up to you. It is more believable to the judge if it is notarized. It is also believable if his signature is a good match to what is on his driver's license.
Another piece of evidence is to not give him cash for the loan. Write him a check. Keep a copy of the cleared check or the copy the bank sends you with your bank statement. This will also show the judge that you paid him. If you pay him in cash, there is no proof and is considered hear say. Unless, you have the signed document I mentioned above. |

Only if you have him sign a contract stating when and how he will pay you back. Otherwise it could be considered a gift and taking him to small claims court would probably cost a lot more than you loaned him. |

Get it in writing. If it were me I would not loan him money to buy it. He sounds like he wants a toy and does not really need it. If you are trying to get out of debt do not get extra money on the loan for this. One more thing, when you pay off those credit cards do not destroy them but put them away and do not use them. |

DO NOT LEND TO FAMILY AND FRIENDS. It is the one sure way to destroy a relationship.
If he is credit worthy he can borrow from outside. If he cannot do that it means he is a bad risk.
He will resent having to repay you, he will delay and miss payments and in the end you will break up for sure and you will not get your money. It happened to me and everyone else I know. Far, far, better to be kind at the beginning and say "sorry, but I love you too much to lend you money as I know it will break us up". Be kind but absolutely firm. It will only be a couple of minutes embarrassment compared with months and years of wondering and worrying. DO NOT DO IT |
