I lent someone 50,000 $ and they did not pay it back. I have a promisary note. What are my options?
I have written them letters, I have offered payment plans, I have offered to forgive the interest and after 10 years, they still refuse to pay even though their kids have all gone to Christian school.

When it comes to money that's exactly where Christianity usually stops. I've borrowed off a lot of people and always paid back when I said I would. People have came back to me and said so and so was talking about you they said you were the only one that paid back when you said you would. When I lent out no one remembered and talk to me like nothing happened or they just promised to pay back. Now I'm broke no one wants to pay me. Oh well may be some day I'll learn who really is the fool because when they come looking for a favour I say " you don't remember now you want some thing from me " People usually walk away after I say that.

Sounds like you need to file a law suit. Contact a lawyer...maybe a letter from a lawyer may get them motivated.

One thing I have learned is that if they are waiving the christian flag all the time it's so they can cover up something else.

Live-it, Don't tell me about it! I've been ripped off by more people pretending to be Christians than anybody else.

People use the Christian thing just to throw you off guard.

Get a lawyer or a ball bat. The lawyer will cost you money, the ball bat will cost you time.

Your options depend solely on whether they can pay the money back or not. I assume you know them well, so answer that question honestly. If they can, then you need to file a lawsuit against them. That may get them to pay, if not you will have to go to court, and you had better have good paperwork documenting this loan, ie loan agreement, bank statements, cancelled checks.

Has this person ever made an attempt to pay back this loan? That makes a huge difference in a court room.

You have two prove two things in court if they fight it:
1. You made the loan
2. They agreed it was a loan and agreed to the repayment terms.

If they don't fight it, you get a judgement against them on the cheap and then you have to collect it. If they have money, start attaching their assets, homes, cars, etc. They will start writing checks. But, don't go after anything they owe money on.

Step one: file the promissory note with your County Recorder's Office.......

If they own real estate: hire an atty and file a lien against their house.....don't forgive interest and penalties and lawyer costs....

....in some states you can actually file a lien w/out a Court Judgment....don't know how, but its a possibility.....


In some states, you can also garnish their wages/bank accts.....hire the atty to get a Judgment in your favor and get the judge to issue an Order of garnishment.......attach their paycheck.....

You have options......just be sure you include all your collection expenses in the amount they owe you.....

Considering it just wouldn't be proper to hold them at gunpoint, you should bring a lawsuit against them. Give them advance warning, though, so that you don't look mean or Scroogey even to them.

i would get a lawyer as fast as possible. its not right for someone to take that much money and not repay it and it sounds like you have tired to help this person repay it. shame on them. i guess what they say is right: no good deed goes unpunished. sorry about ur unfortunate situation

You are so out of luck. With no written proof of the debt there's no paper trail to prove they owe you. You've been scammed!

in most states this is considered a civil matter what you need to do is get your facts together (copies of all the letters you have sent. certified would have been your best bet) and go to magistrate court you and your case will be much better prepared and COULD be decided in your favor if you and the other party signed the note containing if, how, and when they should pay you back by from the begining. your best bet nail them to the wall for the 50 large plus tax them. FYI their kids going to christian school has nothing to do with them not paying you back.

I don't see why they'll not pay, but then again we only have your side of the story. Was it legal money that you lent (eg. not drug money or blood money, etc)....

Collect all your paper works, then:

1. Talk to their church elder to intervene. Their shame might work on that;
2. Let a mutual friend arbitrate - might help if that friend is either a respectable one or the complete opposite - the bully;
3. Try a collecting agency;
4. Put a lien on their property;
5. Hire a person with an iron fist (is it legal?)
6. If it's okay with you, I'll collect from them but we'll split the money 50-50.....lol
