I doubt she will take you to court. Since she was stupid enough to loan you 35k, she wont be smart enough to take you to court.
No sane person in their right mind would loan someone that kind of money. |

If you received the money from her, generally yes.
I would avoid the mess and set up some of mutually agreeable payment plan. Nothing is worth your reputation. |

Yes, of course she can. Just because she hasn't signed anything doesn't mean you didn't borrow it. I'll tell you another thing, Judges often don't really care for deadbeats, and there is probably a pretty good chance she'd win too, as courts don't like to feel like bill collectors, and frown upon people that welch on their debts. As long as she can prove that her story is true. eg. she says she withdrew X amount of dollars on such and such date, and she has a bank statement to back it up...your bank statement (if you deposited it) that shows you received said amount...etc. The long and the short of it is this...you would be better off trying to come up with a payment plan to at least show you are sincere in paying her back...offer her postdated checks...in an amount you can afford, and judging by your pic, that won't be much.
By the way, if you don't pay voluntarily, the court can also award interest and costs, which could bring the amount to well over 50 grand...you can pay now....or pay a lot more later, and the interest will keep accruing until you cough up...Good luck buddy, cuz you just may need it... If she can prove that you owe her the money, yes she can take you to court. She was nice enough to lend you the money so why don't you just pay her back. And if she can't take you to court believe me she'll find another way to get her money, |

Yes.
Although it will be harder to prove without a signed contract, it can be done.
Things like verbal agreements and handshakes are held valid all the time. |
