I quit a day before payday, a year ago. How do I get my check?
Let me make this short. I worked at Old Navy for about three months until two weeks before Christmas of this last year... when I walked out of the store, quitting on the spot. One of the managers in the store had been making advances on me and even went so far as to close the dressing room door as I was folding clothes inside and grabbed me. So immediately after I clocked out and walked out of the store and never came back (too freaked out)...

I know it was a bit irresponsible of me to quit on the spot and never return for a check or to even notify a GM about what had happened, but here I am anyway in a job I now love but wondering if there's a way to get that check back (I quit the day before payday).

It has about 35 hours on it... Knowing that it is almost a year later, I would still like to have it. But there is no one familiar at the old store, and no one at that location seems to have it or know anything about it.

Well, someone in payroll knows where it is. Ask the store manager to give you the telephone number for payroll/benefits. If you can't get any satisfaction, call your state wage/labor division and tell them your story.

Why did you wait so long? I am sure there has to be a way to get it. You'll probably have to get the companys number and talk to a payroll person. That is the only way that I can think of. I am confused on why they didn't mail it to you. :/ Find that out as well. Good luck.

Old Navy should have a payroll department. Call the main number and ask for them. Explain the situation and they will probably want to know whether you want it mailed to an address or if you'll come in to pick it up.

On another note, you should have filed for sexual harassment. You should not have had to quit, that manager should have been fired, and corporate would agree.

I'm sorry to hear of the sad situation that led you to quit, and I can understand that you didn't want to have to deal with your boss after that incident. On the other hand, you could have filed a formal sexual harassment complaint on your boss on the spot. Old Navy must legally investigate it under title VII. Chances are that if he's still with the company, he's harassing someone else.

In any case, you should write a letter to Old Navy's Payroll department explaining the situation. They would have all your past pay records and should be able to verify your 35 hours. Google Old Navy for their corporate headquarters and contact them for the mailing address of their payroll department.

In your letter, also give them your full name, employee number, if applicable (it may be on your last pay check stub), the dates in which you worked, and the store location. State your supervisor's name if you remember it. Send your letter certified mail with a return receipt.

Finally, if the harassment incident occurred just last December, you might still be within the 300 day statute of limitations for filing a sexual harassment complaint. It's something to consider to alert Old Navy to this person. Their HR or legal department can direct you to the appropriate filing office.

There is no need to hire a lawyer for this. You can either contact corporate yourself and ask for it or file a claim with your state's department of labor.

Most paychecks are only valid for 90 days, which is about 3 months. You will have to call the corporate office and ask them to reissue the check.

But because you didn't take care of this you might be out of the money.

i would call them up and they probly should have a record of it and if not i guess ur screwed... but just keep asking them and maybe they will actully look into it cuz most people just kinda shrug it off and screw u over...

They should have mailed it to you. Contact their corporate Human Resources Department which I think they are owned by GAP

The best and most effective way of getting your paycheck would be to call Old Navy's employee headquarters, and ask them to patch you through to the payroll department. From there you will probably be asked your current address and they should mail it to you.
I know some companies void their paychecks after 90 or so days, but there still is a chance it will be valid. If it isn't, ask someone at their payroll / human resources department if they can write and mail you a new check.
Otherwise, go back to the store you were employed in and raise hell. An employer can't deny you payment for your labor, that's called slavery.

You could go to small claims court and file a lawsuit. Or hire a lawyer and see if he can get it without going to court. Probably not worth it for that amount though.

Try calling the corporate office and explain the situation.
