Consult a lawyer. Do not spend the money they are giving you. Make sure you understand what you are entitled to as you have been terminated and see what your options are. By accepting the payments you may be sacrificing a greater potential severance. Talk to someone who can guide you like a lawyer. |

they can take it back its their money. human errors occurs all the time. unless they have written in documentation that they're still paying you then you need to talk to the management and explain it so that way a year from now they realized whats going on and will want the money back |

Are you sure it isn't just the last of your wages? Pay cycles are usually delayed two or three weeks, so if you were only recently fired it could still be the money you earned. |

it could be just pay that you earned. Its pretty typical to have a delay of about a week after the closing of a pay period before you get your paycheck. For example I'm paid every 2 weeks with a 1 week delay. So its 3 weeks after the 1st day of a pay period before I get the money.
If they really are over-paying you, they can legally demand the money back, just like if they under-paid you, you could legally demand the money they owe you. |

The money is not legally yours. If the account is still open, they can reverse the transaction (take the money back out). If you close the account, they can come after you for the money either via collections or lawsuit.
Just because they made a mistake doesn't mean you can keep the money. |

I doubt they run you through their payroll if you're not clocking in and out. It's probably your old hours worked that you're now getting paid for. If they accidentally did that, usually they try to work things out outside of court, if it's huge, they might sue. Good luck |

It depends which country you live in. In Japan, when the bank makes a mistake, they suffer. In the US, the bank can take the money back.
Is it possible you're getting back vacation pay or severance pay? |

They probably can sue you to get their money back.
Just play ignorant and when the catch their mistake tell them you assumed it was some kind of severance package. Don't leave the money in the bank--spend it and have fun.
When they do realize their mistake it may cost them more to get the money back than it is worth.
If you were truly fired in an unfair way then go ahead a screw them---that is the way capitalism is meant to play out!! |

They cant. Its not your mistake, And if you think you have been fired in a very unfair way, you should report it to the Labor organization / Union. They cannot sue you, even if you decide not to inform about the payment you are getting. |
