I think i'm in big trouble please help.?
I bought my house over 2 years ago, it had a gas metre installed where u have to pay using a card, I wasn't happy with this method so I phoned the gas company and asked them to take this metre away so I could have a normal one and pay monthly via direct debit, (which they did) I set up a direct debit, then after about a year I changed bank accounts so phoned all the companies to transfer my direct debits and discovered that there is no debit in place for my gas as they think I have a card metre still installed!! I didn't say anything as I paniced that I would owe them a lot of money, as far as I was aware the debit was coming out monthly (I never really check my statements just my balance silly I no) plus I had never received a bill from the company either. Its being another year since then and I have still said nothing, I no it is wrong but I just can't afford to pay a huge gas bill. I no they will find out eventually, is it their fault or mine, would I have to pay all of it??

I also set up a direct debit with the same company to my my electric and this has been paid every month.

First of all,don't panic, even if you have to pay it all back, then they will let you do it in instalments, nobody will force you to pay it all back in one go, so please don't worry about that. If I was you, I would go to the citizens advice bureau, and explain whats happened, they can telephone the gas company and explain what has happened on your behalf, its better to sort this out sooner than later, as you will only worry yourself sick. Please don't worry.

Something similar happened to a friend. They ended up having to pay but not nearly as much. If you can talk to them they may sympathize.

Get to them first and they will be more understanding they wont expect it all at once do not worry but just sort it now before it goes any further.

they can get this money from you as they may have made a mistake .....but that is different from a mistake of law....

however, if i were you i would negotiate to pay it in instalments and they will almost certainly agree

Gas and electricity company never admit making a mistake ever. They blame the customer, you in this case. If you owe any outstanding monies to them, they will collect, either you pay or they take you to court.

It's like this.

You, me and all of us are just single pins at the end of a bowling alley - down comes the ball. You are knocked over. The rest of us are so smug we never think it will happen to us.

You had better contact your local Citizen's Advise Bureau [CAB] - get a consultation and see if they can help you with this.

I had a similar experience. moved to a new house and signed with scottish power, never got a bill, i rang and rang for 2 years before it was sorted (lost paperwork)

You will most definitely have to pay this off buy I know someone who was in similar circumstances and he managed to change suppliers before they noticed. If you're able to do that then there's nothing they can do as legally they have to ensure all your debts are payed before they release your account for transfer.

You are both at fault. I have direct payments made from my account but check to make sure all payments were made on time. Errors do happen. I be live if you contact them on your own they will work out a payment program with you.

Please don't panic. I changed suppliers a couple of years ago and didn't get a bill (even tho the meter was being read)
I phoned and phoned and phoned. They were very helpful and eventually set up a direct debit with an agreed payment per month (more than we actually used). Also they sent a card which I could take to the Post Office and pay in as much as I could afford at the time. Glad to say I am now actually in credit. Once again do not panic.

The responsibility for resolving this lies with both you and the energy company.

You knew you were not receiving any bills, so you should have queried it, and they should have updated your account to change it from a prepayment to a credit meter when it was changed.

The reason no-one has come to read the meter you have now is because their computer system thinks you still have a prepayment meter, and they don't read those.

This is what you have to do: contact the company directly and explain the situation. Tell them exactly what has happened. Explain you are willing to pay for the gas you have used, but you can not afford to pay the bill in one lump sum.

They will be obliged to investigate the matter and calculate the gas usage over the period in question. They then have to provide you with a bill for that amount and discuss payment terms.

I am sure your company will have no hesitations in setting up a payment plan to spread the cost of that bill, plus your current usage over a year or two.

Also bear in mind that they are quite within their rights to insist they put a prepayment meter back in to recoup the money if they want to. After all, the meter and gas supply belongs to them, not you.

If they chose to leave the credit meter in place, they must also update your account to show that you now have a credit meter in place and not a prepayment meter to ensure you are billed correctly in future.

Ignore the advice to change suppliers in the hope that no-one will notice. They will notice it and they will block the move until the debt is paid off. They are legally allowed to do this.

Good luck in getting this problem fixed. The worst thing you can do is leave it any longer.

If you gave them your account details then it was in their hands to transfers these details. But as they have not done so you will have to pay this money back to them but not in 1 lump sum. You could have a prepayment metre re installed and they could take small amounts from your account that way to repay what you owe. But i would find out why they did not take the direct debits for so long before you do anything. Also ask them how come nobody has been out to read your metre! They would have noticed it was not a prepayment metre - no slot for card etc

You definitely do owe the money for the gas that you have used, but it does seem to be the supplier's fault - they swapped the meter, so it should be on their records!

With help from good advisors, you should be able to negotiate an agreed total to pay (not necessarily the whole amount) and a comfortable instalment per month. You may also be advised to contact the Energy Ombudsman, who will help sort out disputes with suppliers. http://www.energy-ombudsman.org.uk/

You will have to pay it all off, but it would be unfair of them to ask for it in one go. You should be able to come up with a mutually agreeable payment scheme.

Or, you could try changing suppliers - they probably won't even notice....

Its their fault, but that won't stop them from asking you for the money. You can do 2 things, wait for them to discover it and then come to some mutual agreement of how to pay it back slowly or change suppliers (and hope it won't be noticed).

Well I assume it's their fault. You said you wanted to pay via direct debit, and they said fine, so they are the ones to blame
