Since your bills were incurred separately, there are probably two bankruptcies here. Marriage could very well complicate things as spouses can be held liable for each other's debts. First, you need to hire an attorney. Second, if you are going to file bankruptcies, you probably are better off postponing the wedding until the bankruptcies are all discharged. It could mean postponing your wedding for a couple of years.
Also consider that you two would be starting married life with credit ruined for 10 years. Bankruptcies remain on your credit records for 10 years after the court discharges the bankruptcies. As public records, of course, they are permanent, and your great-grandchildren will be able to access those records. But they come off the credit report after 10 yrs. Meanwhile, of course, your bad credit is worse than it is now.
Perhaps you two need to find a way to pay off your debts, and clean up your credit, especially if you would want to have a child and get a home within the next 7 - 10 years. |

Don't listen to strangers on the Internet. Visit a bankruptcy attorney TOGETHER and let the attorney tell you what would be the best filing status. There are pros and cons to filing a bankruptcy jointly; in some situations you come out better and in others you come out worse.
The visit to the attorney is FREE for a consultation, and you both need to go. There is a means test that must be met, and that varies from state to state. Sometimes you are better with just your income, and sometimes the two combined incomes serve you better. The attorney can advise you. |
