The bank have obviously made a "human error". Any human can make mistakes. It is your responsibility to ensure your bank account is correct because although the bank are at fault, they wouldn't have put the money in your accoun deliberately. Legally they can take the money back at any time (although morally they should advise you what they have done) and they can back date it to the same day the money was credited to automatically adjust the interest. If you spend the money then you will be expected to replace it. You are probably better off telling them about it before they notice for themselves because they MIGHT reward you. If they money belongs to another of the bank's customers then they will notice a shortage, report it to the bank and the bank will be able to trace the money and remove it. If you keep quiet about it then you may genuinely spend it by mistake but will still have to replace it. |

so tel lthe bank. if they dont do anything about it put it in a high interest account. when they ask for it back you pay it, but get to keep any interest you have earnt. |

Yes. You're legally obliged to return money that KNOWINGLY isn't yours. It's only if you couldn't reasonably be expected to know that the law would be on your side. So if £10 went in odds are you'd never know, or maybe if £400 went in and your bank balance was in the £10,000s then you wouldn't know. As it is ...... |

Yes, they'll just take it out of your account once they discover the mistake. I once wrote someone a check for $1000 and they cashed it right away. But it didn't come out of my account until six months later. And you better believe I left it alone, I knew they would find the mistake eventually. |

Mind you - many years ago I went to put my YTS money into the Halifax and when the envelope came out - there was nearly £500 inside - I changed the amount putting in to £517.00 and they never found out (naughty)!! |

yes. you'll have to pay it back. they may make mistakes, but there's a "paper trail" to everything they do. If the go looking for it, they'll find it. besides, that $400 belonged to someone else. How would you feel if YOU make a deposit and it accidentally got put into someone else's account? |

If they deposted less and it was their fault would you expect them to make up the difference? Of course you would, because it's your money. Well, the 400 is *their* money. It belongs to them so rest assured they will take it back. And they will eventually find the mistake. (They've been doing this banking thing for a while now.)
A friend of mine had this happen. He was credited $5,000 instead of $50 by a credit card company. He spent it thinking they wouldn't figure it out. He was in a bit of a pickle when they took him to court. |

Yes, I was a bank manager for 5 years. Most of the time the money was placed in someone elses bank account by mistake. A dispute would be filed and the money would be found by tracking the transaction numbers. The customer who received the amount by mistake will be contacted by the bank and informed of what happened. The bank will then take back the amount in full. The process can take as long as 7 business days depending on the size of the bank. |

You will have to pay it back because it is not your money however they have made a mistake with your account and someone Else's. If it was me I would put in a complaint to the bank asking for compensation for the time spent in helping them to rectify the problem. They will have to take this seriously and you may walk away with some money that is yours. Law states that the complaint can be in writing or verbally.

Empty the account, and then close it!!
Legally they have no right taking it without your permission, even if it was a mistake by them!
Halifax put an extra £100 in my account when paying in one day, I kept quiet then the day after it had come out again.
I kicked up a sh itstorm and they put it back into my account, and then wrote me asking for permission to have it back.
I threw the letter out and kept the money! If they'd asked 1st I've had let them have it, but as they took first, Screw Em!!! |
