If i filed for bankruptcy can they touch anything my wife owns?
also do they come out to your house to have a look at what you own or do they take your word for it?

Hi. as you are married you wife doesnt not own any property. Under English law all property and possessions are marital property owned equally by both partners.

Any marital property can be taken in payment of debt owed either soley by one of your or equally by both of you.

they get your wifes if you include her int eh bankruptcy . they dont see things at your house though

When you file for bankruptcy you have to tell them any assets the people you live with have . IE a car or property or savings in the bank.

depends on how your wife became the owner and when.

assets transfered in anticipation of the bk filing are subject to being reclaimed for benefit of the creditors and woe to you if you live in a community property state where everything is assumed to be owned by both of you unless you can prove otherwise.

I would seek professional advice to discuss you options, as Bankruptcy may not be the right solution for you. Have you considered an IVA?

You do have to be completely honest with them about your assets or your will have a lot of problems.

As far as i know, they come to investgate of course, not sure about your spouse. better ask the solicitor

no , its just a freze of acount, stops u getting more dept, or gaining interest on what you own, it should only stay in place for a year, but only use it as a very last resort

Yes, unless you have taken precautions to guard against this. I have a loan but I took out insurance so that if I die or declare bankruptcy , it does not affect him.

They could reposses items that you have in your house unless you wife can prove on paper it belongs to her.

What i would suggest to pack up the valuable items and store them in a family members garage or a hire a storage locker and put them in there until your in the clear from them.

They can come to your house. Sometimes the Official Receiver will go there instead of you going to them. Not sure about wife's belongings. Don't think they can touch it but only if she is not included.

No but I cant see them taking your word for it, you'd presumably have to prove it wasn't yours
