If my estranged husband died would i be expected to pay his debts?

Tag Your It
Yes . . . unless you divorced . . . and any shared debts that has occurred while married you will still have to pay off.

reality
Probably.

Here's the deal:

When he dies, any of his estate can be taken to pay off his debts. That means any bank accounts, house, cars that are in his name or joint with his name on it. However, after all of that has been seized, you can not be stuck in debt. Whatever other debt he has racked up, basically disappears after all of his estate has been taken.

So, start saving into your own account, if you haven't already done so. See what you can do about getting anything you shared into your own name as well.

Very likely. One of the good reasons for a divorce.

I would imagine so. Even when your divorced if both of your names are on a loan for instance your both responsible until it's paid off. Now if he has credit cards under only his name then perhaps you wouldn't have to pay those. If your not divorced, but not together you might want to think about untangling yourself financially from him. When I got divorced it took a year to get our names off of everything.

YA is a sham
If you are legally (have filed legal papers) separated, no. You could still be sued in court and would have to prove his debts were incurred after your legal separation. Otherwise, you may be legally responsible.

miaka921
Yes. You have to be divorced to be free of expenses or at least legally separated.

airangel54
If your still married and don't have a legal separation, unless you can get a lawyer to do something ,if you have been living apart for some time.

Humn'bird420
You are expected to pay any of your spouses debts, thats where they mean you become one at marriage.

I'm not sure, but I think that unless you are legally divorced, you are responsible. Even if you are than you might be responsible if it happened while you were together.

You have to pay if he left anything behind worth anything, like a house or a newer car, money, or anything of value.

Hopefully you had a separate bank account and not joint. If you had a joint account then some of that money is also his.

I'm not sure about life insurance, but I don't think you have to the life insurance to pay off the persons bills that died.

They will bother you to pay, but there are laws, try to look them up on the internet. There are laws that say what you have to pay and not have to pay.

Yes, more than likely. His life insurance should have covered all that if he had any.

If you are still legally married yes.

Yes. If you are still legally married then you would be responsible for any debt your husband leaves behind. If you do not wish to carry this financial burden then I would suggest a divorce.

yes

If you are still married it does. sometimes it depends on the state you live in.
