If you beome bankrupt, are the creditors allowed to take your car?

they can take all your luxury items including car, microwave, stereo,tv,jewellry, cameras, pc, mobiles, they are only obligated to leave you basics. and if you try to say it belongs to someone else they have to produce receipts at the courts so you cant say it owned by friends or other family without proof

if it belongs to you and there is no outstanding credit on it, yep
they'll use it to pay off some of the priority creditors.

The creditors themselves cannot take anything until the courts have sorted everything first

Barry auh2o
They can't take the fillings in your teeth or your children. and it is unlikely they'd want your dog, but unless your car is a 15 year old Ford, you can kiss it goodbye.

It depends on your state's law and how much equity (value minus loan balance) you have in your car. If you have more equity than the state allows to be kept, your car is vulnerable. If the equity is lower than allowed, you will be able to keep it, but if you owe money, you will have to re-affirm the loan with the lender.

First of all noboby becomes bankrupt, you allow yourself to get in that sitution by not paying your bills.
The creditors will take everything you own now and even in the future.I hope you learned your lesson.

Well, they MIGHT, depending on how much you owe. If its a lot, id watch out for a letter in the mail talking about it.

schnauzer2
It is not your car, you owe money to people so they take anything worth anything at all to pay some of your debts. They can even take your house if you have bought it.

Sorry , yes they can , becoming bankrupt is the worst way to sort matters out ,

Yes, in some circumstances, along with anything else they may deem an asset ( your house, stocks and bounds, shares, expensive furniture, works of art etc.) There are other things too, but I can't remember off hand, sorry. They sell these things and use the money to pay off some of your debt.

flieder77
Yes

vera-ann
Yes they can take everything.

kim j
the creditors cannot take your car or your primary residence, especially if you live in florida.

aj485 is right,

It depends on which state you live in, and how much equity you have in it. But if your upside down on it, then they won't take it if you continue to make payments on it, The federal exemption is only $2,775. So this means if you car is worth more than that, they can take it. The only way around this is if your state has a higher exemption, For example, in Texas you are allowed to keep personal property as long as it doesn't exceed $30,000. And in Texas there is also an unlimited homestead exemption, which means they can't take you house no matter how much it's worth.
