Go to the local county police department and file a theft by check charge against the person. You can add any expenses that you incurred at your bank as well. The DA will take over from there, and depending on the amount of the check they will prosecute as necessary. |

Effectively you were scammed. (This is what the fake check scammers do. They give you a check that will not clear and hope you will give them money before you realize you won't get anything.)
Worse, the kind of person who would do this to you *might* pay you back, but would never think to reimburse you for any bank fees you incurred. |

send the check writer notification that the check was returned, do this in writing send certified and request a receipt, you have to give them 10 days to make restitution, After that time, contact your local magistrates office and you can file charges. Good luck with it! |
