Im filling for bankruptcy?
i owe 20000, my partner lives with me and is debt free can he have any of his belongings taken off of him, he owns 2 cars

If you do not own the items they should not be included but bear in mind that you do live with the person and the court may decide you have a legal interest (use) in one of the cars. You would be better off asking the official reciever (contact details through the court).

I am sure that having made this decision you have fully understood the advantages and disadvantages ?? Particularly your situation as a home owner or a tenant?

There are other ways of dealing with debts. Citizens advice bureau have or can put you in touch with money / debt workers who are free to you and their services are second to none when it comes to dealing with personal debt in this country

No, he is separate from you if you are not married.

I'd seek professional financial help before I would declare bankruptcy. That is a last resort kind of action and will follow you for many years.

Nope....your bankruptcy involves only your assets and liabilities.
Your partner is in the clear

alatoruk
no, but he will have to prove they are his and that you have no interest in them.

So long as only your name is on the accounts, they don't even have to know your partner exists

No you are the one going bankrupt not your partner. You do not lose your belongings, just valuable assets, like your car if worth more than about 2-3 thousand but then if needed they woulds allow you the money for a cheaper one, equity in your home if you own it, premium bonds, savings thing like that but they wont want your telly or three piece suite, you have to live. They are no the bailiffs.
Take no notice of the silly answers they just dont know how or why people reach these situations it is just ignorance.

All the best

If you live in the UK bankruptcy lasts one year. Providing he is not named on any of the finance then his assets cannot be included in your bankruptcy.
If you need any further information you can go to http://www.insolvency.gov.uk/faq/faq.htm
Bankrutpcy is a very simple process these days. If you decide this is the best option for you, good luck.

No they can't take anything that's not in your name also they can't take everything you have to be left with what is needed for everyday living, so it's only what is in your name.

falisrm
no, you file seperately from him. you have to figure out what you own and what he owns. don't cheat.

I owed $35,000 a few years ago and almost filed for bankruptcy. I'm glad i didn't. i can't remember what my debt to income ratio was at the time. I still only make $40,000 a year. I only have $6,000 left to go. took 2 years so far.

get a job and stop using him to support your bad spending habit. if you file you'll regret it.

Seriously reconsider filing bankruptcy. $20K really isn't that much and a bankruptcy will haunt you for years. Work 2 jobs if you have to, sell some of the stuff you had. You can get that paid off if you work at it. Have your partner help you with that since it sounds like that person is good with money.

The Chapter 7 bankruptcy is applicable if you have no regular sources of income. It works by reducing or clearing off all your debts. You can then make a fresh start without having to worry about having to pay your debts.

Once you file for Chapter 7 bankruptcy, the bankruptcy court assigns a trustee who works as an intermediary between you and the debtors. He oversees everything and checks out if the bankruptcy plan is going as planned.

I would not lose any sleep over it. Screwing someone and getting away with it will give you many proud memories to tell your grandchildren. Your partner will also be able to sleep easy knowing that your careful structuring of the debt in your name has nothing to do with you. You are surely a fine example for future generations.

Bankruptcy is a 10 year mistake. You can avoid it with a solution from http://www.your-credit-solution.com/debtsolutions.htm .
