gemini | Is it a scam? |
im a 24 yr old women, ive managed to get myself into a bit of a situation after a run of bad luck, someone ive met has offered 2 help me out, i am a little wary of this though as in my experience no one really wants 2 help anyone else unless their gettin somethin outta it thelmselves.I wish i was a little more trusting but find it hard 2 be. The only problem being i do really need a way out , and this is probably the only way. I was wondering if i signed a contract that someone draws up ,how binding would it be? its not a proper contract but would it still have 2 be honoured? I would really appreiate any answers, thankyou for your time, bex.xxx Additional Details well 2 be more detailed as many of u asked, ( sorry didnt want 2 run on 2 much b4!) ive had 2 leave my home due 2 a family breakup - 4 various reasons im now left in a situation where i have 2 find the money 4 a months rent in advance and a depoist.I dont have anyone i can really turn 2 which is why im writing this, im quite desperate now for some ideas.I have been offered help off a bloke i know ,he seems ok but i dont really know him that well, hes offered 2 help me get the money in the form of a loan, i really dont know what 2 do , i seem 2 be going from bad 2 worse. |

a contract, by definition is an agreement between 2 or more parts on something
if you sign a paper, or even if you agree on something verbally, that could be proved [so easy now a days with voice / video recording phones], you'll have to abide or you might get in trouble if the other part[s] put you in court
you should be really careful if it is a money question, specially if you're offering any sort of collateral, like your car or house, or ... who knows ... just be careful and go with your instinct: that's true that most of the people wouldn't do nothing for you don't return with something |

Hi,a contract is legal & binding. If you are wary of the person who wants to help then do not accept it.Good Luck |

Anything you sign has to be honored. Once you sign something it is considered a contract. Be careful and if it has to do with a loan. Make sure they are not asking you for no upfront fee's. If they are, it's a scam. |

You could write a contract on your chest and it would still have to me honored if it was made properly :) |

What do you mean "Its not a proper contract"?
There's no such thing as a non-proper contract.
If you sign a contract, you are bound by its terms. |

if there is an alarm bell ringing, making you think it might be a scam, then trust you instinct, no matter how desparate you are. If it sounds like it is too good to be true, then it probably is, as a rule of thumb.
Contract law is complex and depends on your jurisdiction. |

even if the contract is jotted on the back of a cornflakes box, if you have both signed it , then it is legally binding. |

Go to the FINDLAW link at the source below...and select your state and give the issue as ... "contracts" ...
or speak with a professor at a college that teaches law...on the subject: CONTRACTS...he may be able to tell you whether the instrument is valid or not based upon criteria present within the document.
or speak with a judge and request a summary judgement on the validity of the document...costs a little...may save time in the long run. Also, the determination will be of use if future litigation ensues...either way...you doubted the validity and signed it as a ruse..perhaps. (thought it a joke) |

Yes it is.... its also can be called a gentlemans agreement which is binding by law.
If you dont feel comfortable about signing it then DONT!!! |

Define "proper contract". Any document that is signed by the parties involved is a contract and yes it will have to be honoured.
If you have doubts about what you are signing, get a solicitor to give it a once over.
DON'T sign anything until you understand the implications.
EDIT: If you don't know the guy that well then I would be wary of lending money off him. How is he planning to help you get a loan, will he be your guarantor? |
|

You'll have to be more specific.
Edit: Well if you don't trust him, try getting a loan from a bank, friends or family. Other than expecting more than just payments with interest, what are you concerned about? Really, wouldn't he be the one to worry that you may not pay him back? Or is he a shady character? If you sign a contract, make sure you read & understand ALL of it. If not, have a lawyer look at it. But it should be worded simply, only stating parties involved (you & him), dates of loan & of payments, amounts, interest rate and what should happen if you don't pay on time. |

You have trusted someone to put your signature to paper and now you have lost faith in that person. Then it is a scam. The law can be in your favour depending on in which land you live. In the UK go to the CAB, they may advise you to see a solicitor. |

The one thing Ive learnt about being in a bit of a bind is that.. There is always another way out, you just have to look hard enough.
Signing anything that is in a form of a contract has to be honoured, even if its on a tissue paper, there was an agreement between the 2 people.
If your not sure that you can go through it, then dont sign it.. Look for another way out of whatever it is your in. At least you dont owe anyone anything and you still have your dignity :)
Good Luck with it. |

If you're going to sign a contract, already wondering if it needs to be honoured, it seems that it's the other person who should be trusting you.
If the contents of a contract are not themselves against the law (in other words, you can't litterally ask for a pound of flesh, like in the Merchant of Venise), then it will probably have legal value. |

Its a scam. Only sign stuff that your solicitor has read and approved. Anything else probably wouldnt be legally binding but you never know. Be very very careful. Go to the CAB and explain your situation. They will be able to advise you on how to get out of debt without digging yourself in deeper. |

You've not really given enough to go on here. Who is this 'someone'? An individual? A company? I'd be immediately less trusting of a single person who comes out of the woodwork and wants to help you, seemingly selflessly.
Any 'proper contract' has to be honoured. Any contract that isn't considered 'proper' isn't worth the paper it's written on anyway, and will leave you in a sticky situation just as much as it would for the other person.
Be careful, and don't trust anyone you just met. |
